{"data":{"id":"us-ky/krs-65.8909","jurisdiction":"us-ky","citation":"KRS 65.8909","heading":"Procedure for inclusion of entity in existing regional wastewater","body":"commission.\n(1) Any entity listed in KRS 65.8903(2) that did not participate in the initial creation of\nthe commission may elect to participate in the operation and appoint a\ncommissioner to an existing commission. To elect participation, the governing body\nof the prospective member entity shall follow the process set forth in KRS\n65.8905(2) to (5).\n(2) After the process set forth in KRS 65.8905(2) to (5) is complete, inclusion of the\nprospective member entity in the existing commission shall be granted if the\norganizing official finds that such inclusion:\n(a) Satisfies the criteria set forth in KRS 65.8905(5)(a) and (b); and\n(b) Will assist in achievement of the purposes of KRS 65.8901 t o 65.8923 and\nwill be advantageous both for the customers of the prospective member entity\nand for the customers of the existing member entities of the commission.\n(3) If inclusion is granted, the organizing official shall enter an order authorizing the\ninclusion of the member entity. The chief executive officer of the member entity\nshall appoint a commissioner to the commission in accordance with the process and\nrestrictions set forth in KRS 65.8907.\n(4) The term of the newly appointed commissioner shall b e determined in accordance\nwith KRS 65.8907(4), but may be adjusted by the commission so that no more than\none-third (1/3) of the terms of the commissioners expire each year.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39878","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:23Z","sha256":"697f31708de97525eefb501d40930de10f232bcb63d9797951382ad2db450a48","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.8907","next":"us-ky/krs-65.8911"},"notice":"GroundRules: Original legal text.
