{"data":{"id":"us-ky/krs-67.040","jurisdiction":"us-ky","citation":"KRS 67.040","heading":"Fiscal court -- Members -- Presiding officer -- Deadlock.","body":"(1) The fiscal court of each county shall consist of the county judge/executive and the\njustices of the peace of the county; or of the county judge/executive and three (3)\ncounty commissioners elected under KRS 67.050 and 67.060.\n(2) The county judge/executive  shall preside, if present. A majority of the justices of\nthe peace or commissioners shall elect one (1) of their number to preside during the\nabsence or inability of the county judge/executive to preside. If any person fails to\ncomply with a lawful order of the fiscal court, the Circuit Court, on application by\nthe county judge/executive, may compel obedience by proceedings for contempt.\n(3) When there is a tie vote in the fiscal court in the selection of any officer or\nemployee to be selected by the fiscal court, and a deadlock results and continues for\nfifteen (15) days or longer, the county judge/executive shall cause to be entered\nupon the minutes of the fiscal court an order reciting the facts as to the deadlock,\nand the question upon which it has occu rred and exists, and thereupon, the county\njudge/executive shall make such appointment.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23675","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:25Z","sha256":"e35d78ff7239d563e03d50fb1ae3e7fee6ad06d631b63ca4254860813d82ca9e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.035","next":"us-ky/krs-67.042"},"notice":"GroundRules: Original legal text.
