{"data":{"id":"us-ky/krs-67.060","jurisdiction":"us-ky","citation":"KRS 67.060","heading":"County commissioners -- Election, term, qualifications.","body":"(1) If a majority of the votes cast at an election held under KRS 67.050 are in favor of\nthe fiscal court being composed of the county judge/executive and three (3)\ncommissioners, the county judge/executive shall, no later than the first Monday in\nJanuary in the year of the regular election for county officers, divide the county into\nthree (3) districts as nearly equal in population as practicable, and shall establish the\nboundary lines of each of the three (3) commissioner districts so that each district is\nan unbroken area and not split or divided by another commissioner district. At the\nnext regular election for county officers, and every four (4) years thereafter, there\nshall be elected by the voters of the entire county three (3) commissioners, one (1)\nfrom each district who, with the county judge/executive, shall constitute the fiscal\ncourt.\n(2) (a) In any county containing a city of the first class, which county has heretofore\nvoted in favor of a fiscal court composed of the county judge/executive and\nthree (3) county commissioners, the county judge/executive shall divide the\ncounty into three (3) districts as provided in subsection (1) of this section, the\ndistricts to be designated for identification purposes by the letters A, B and C,\nrespectively.\n(b) The three (3) commissioners shall be elected by the qualified voters of the\ncounty at large at regular elections held every four (4) years. One\ncommissioner shall represent District A and shall be elected at the regular\nelection in the year 1973, and two (2 ) commissioners who shall represent\nDistricts B and C, respectively, shall be elected at the regular election in the\nyear 1975.\n(3) Persons seeking the nomination of a political party as candidate for the office of\ncounty commissioner shall, where a primar y election is required for such political\nparty, be voted upon exclusively by the eligible voters of the district in which the\nperson resides and seeks to represent. Persons seeking the nomination of a minor\npolitical party persons who file as independent candidates or persons seeking the\nnomination in counties containing a city with a population equal to or greater than\neight thousand (8,000) as determined by the most recent federal decennial census\nbut not a city of the first class shall not be subject to  the provisions of this\nparagraph. They shall be nominated by the voters of the entire county.\n(4) To be eligible for election as a commissioner representing one of the three (3)\ndistricts, a person shall have been a bona fide resident of the district he p roposes to\nrepresent for at least one (1) year immediately preceding the election, and, upon\nelection, shall continue to reside within the district he was elected to represent for\nthe duration of his term of office, under penalty of forfeiture of the office.\n(5) Commissioners elected under this section shall take the oath of office and enter\nupon the discharge of their duties on the first Monday in January after their election,\nand shall serve for terms of four (4) years and until their successors are elect ed and\nqualify, or until the effective date of a return to a fiscal court composed of justices\nof the peace and the county judge/executive.\n(6) No person is eligible to be a county commissioner unless he is at least twenty -four\n(24) years of age and has be en for two (2) years next preceding his election a\nresident of the county and a citizen of Kentucky.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43617","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:25Z","sha256":"a09dbb76e439eb1fc1b70a9774768fb7f63fd48419402512b49e7cc2bc080445","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.050","next":"us-ky/krs-67.063"},"notice":"GroundRules: Original legal text.
