{"data":{"id":"us-ky/krs-67.080","jurisdiction":"us-ky","citation":"KRS 67.080","heading":"Powers of fiscal court.","body":"(1) The fiscal court may:\n(a) Appropriate county funds according to the provisions of KRS 68.210 to\n68.360 for lawful purposes;\n(b) Sell and convey any real estate or personal property belonging to the county,\nand buy land for the use of the county, when necessary, for the lawful\npurposes of the county as provided for in this section and KRS 67.083. The\nfiscal court may appoint one (1) or more commissioners to sell or buy real\nestate under this subsection, subject to the approval of the fiscal court, and\nconvey it to the purchaser, unde r the direction of the court, or have it\nconveyed to the court, by deed properly executed and recorded.\n1. When real property is purchased, the county shall pay no more than the\nhighest appraised value, as determined by a Kentucky certified real\nproperty appraiser as defined in KRS 324A.010, or the price determined\nthrough exercising the power of eminent domain, if that power is used.\nA valuation of the real property shall not be required if the purchase\nprice is forty thousand dollars ($40,000) or less;\n2. When real property is conveyed or sold, the county shall convey or sell it\nin accordance with KRS 67.0802; and\n3. When personal property is conveyed or sold, the county shall convey or\nsell it in accordance with KRS 67.0802;\n(c) Regulate and control the fiscal affairs of the county;\n(d) Cause correct accounts and records to be kept of all receipts and\ndisbursements of the public funds of the county, employ a competent person\nto keep such accounts and records, pay such person a reasonable\ncompensation for s uch services, and have the accounts of the county and all\ncounty officers audited, when necessary and in accordance with the provisions\nof KRS 43.070 and 64.810;\n(e) Exercise all the corporate powers of the county unless otherwise provided by\nlaw;\n(f) Establish all appointive offices, set the duties of those offices, and approve all\nappointments to those offices; and\n(g) Investigate all activities of the county government.\n(2) The fiscal court shall:\n(a) Appropriate county funds, according to the provisions of KRS 68.210 to\n68.360, for purposes required by law;\n(b) As needed, cause the construction, operation, and maintenance of all county\nbuildings and other structures, grounds, roads and other property;\n(c) Adopt an administrative code for the county; and\n(d) Provide for the incarceration of prisoners according to the provisions of KRS\nChapter 441.\n(3) The fiscal court shall not exercise executive authority except as specifically\nassigned by statute.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23687","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:25Z","sha256":"b8a0a88b45b986a1f3c843bb89a62ae41c27843d8a665f8ae440342210971081","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.078","next":"us-ky/krs-67.0802"},"notice":"GroundRules: Original legal text.
