{"data":{"id":"us-ky/krs-67.0802","jurisdiction":"us-ky","citation":"KRS 67.0802","heading":"Sale or other disposition of county property.","body":"(1) As used in this section, \"independent appraisal\" means an appraisal made by:\n(a) An individual or organization not affiliated with the county or its officers or\nemployees, using a generally accepted national or professional standard; or\n(b) A county's offi cers or employees using a nationally published valuation of\nproperty based on the most recent edition of the publication.\n(2) A county may sell or otherwise dispose of any of its real or personal property.\n(3) Before selling or otherwise disposing of any r eal or personal property, the county\nshall make a written determination setting forth and fully describing:\n(a) The real or personal property;\n(b) Its intended use at the time of acquisition;\n(c) The reasons why it is in the public interest to dispose of it; and\n(d) The method of disposition to be used.\n(4) Real or personal property may be:\n(a) Transferred, with or without compensation, to another governmental agency;\n(b) Sold at public auction following publication of the auction in accordance with\nKRS 424.130(1)(b);\n(c) Sold by electronic auction following publication of the auction, including the\nuniform resource link (URL) for the site of the electronic auction, in\naccordance with KRS 424.130(1)(b);\n(d) Sold by sealed bids in accordance with the procedure for sealed bids under\nKRS 45A.365(3) and (4);\n(e) Transferred, with or without compensation, for economic development\npurposes, which shall include but not be limited t o real property transfers for\nthe elimination of blight;\n(f) Traded towards the acquisition of the same or similar type of property if the\nvalue of the property the county is receiving in exchange equals or exceeds\nthe actual fair market value of the prope rty it traded as determined using an\nindependent appraisal;\n(g) 1. Sold for its appraised fair market value or a greater amount if the\nproperty is valued at five thousand dollars ($5,000) or less in an\nindependent appraisal without using the procedure set out in paragraph\n(d) of this subsection.\n2. Property sold under this paragraph shall not be sold to a county officer\nor employee;\n(h) Sold for scrap or disposed of as garbage, of which road millings and dirt may\nbe considered as such, in a manner consisten t with the public interest if the\nproperty has no value, or is of a nominal value as determined by an\nindependent appraisal; or\n(i) Sold by the Finance and Administration Cabinet under an agreement with the\ncounty.\n(5) If a county receives no bids for the real or personal property, either at public or\nelectronic auction or by sealed bid, the property may be disposed of, consistent with\nthe public interest, in any manner deemed appropriate by the county. In those\ninstances, a written description of the prope rty, the method of disposal, and the\namount of compensation, if any, shall be made.\n(6) (a) Except as provided in paragraph (b) of this subsection, any compensation\nresulting from the disposal of this real or personal property shall be\ntransferred to the general fund of the county.\n(b) Any compensation resulting from the disposal of real or personal property that\nwas acquired by forfeiture under KRS Chapter 218A or purchased using funds\nrestricted under KRS 218A.420(4)(a) shall be transferred to the account  used\nfor such forfeiture proceeds and upon transfer shall remain subject to the\nrestrictions of KRS 218A.420(4)(a).","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48605","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:25Z","sha256":"7abd75bcd89772418bf8ca82b68fedf20d8c9c7d02fbd1271b80df37904f7724","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.080","next":"us-ky/krs-67.081"},"notice":"GroundRules: Original legal text.
