{"data":{"id":"us-ky/krs-67.082","jurisdiction":"us-ky","citation":"KRS 67.082","heading":"Declaration of epidemic area -- Animal population reduction program --","body":"Liability of state personnel.\n(1) Notwithstanding the provisions of KRS 150.370, 525.130, or any other statute that\nmay be in conflict herewith, any county fiscal court may, wheneve r an epidemic or\npotential epidemic of a disease transmissible to man and domestic animals exists or\nis threatened in any species of wildlife, declare all or any portion of that county to\nbe an epidemic area. Following a declaration, the fiscal court may, with approval of\nthe Cabinet for Health and Family Services and the Department of Fish and Wildlife\nResources, conduct control programs, including population reduction programs,\nagainst any species of wildlife including, but not limited to, red and gray fo xes,\nskunks, and rodents which may be serving as reservoirs and/or vectors of any\ndisease transmissible to human beings and/or domestic animals including but not\nlimited to rabies, leptospirosis, salmonellosis, and Rocky Mountain spotted fever.\nThese control programs may include but shall not be limited to hunting, trapping,\nvaccination, and use of poisons. Technical and operational assistance for the\nprograms shall be made available by the Cabinet for Health and Family Services,\nthe Department of Fish and Wildlife Resources, and the Department of Agriculture.\nA control program established under authority of this section may be conducted by\nthe individual or joint action of the referred -to state agencies, the local health\ndepartment, or individual property owners designated as agents of said cabinets and\ndepartments. In the event poisonous baits are used to control an outbreak of rabies\nin wildlife, those programs shall be under the direction of the Cabinet for Health\nand Family Services. All pet animals in t he area shall be quarantined for the\nduration of the program by action of the local board of health. These programs shall\nbe regulated to provide specific identification of bait station locations, daily check\nof each bait station, and positive pickup and d estruction of all unconsumed baits at\nthe end of the program.\n(2) No liability shall be imposed upon any state agency or local agency or any employee\nor agent thereof for any injury occurring to domesticated animals, individuals, or\nproperty in carrying ou t programs in good faith authorized by this section, but all\npersons and agencies shall be liable to the extent otherwise provided by law for\nordinary and gross negligence.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23690","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:25Z","sha256":"9182aba7c60f5cd39e979cb032a15775c4085427be26dcb561cc26e1378e2bbb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.081","next":"us-ky/krs-67.083"},"notice":"GroundRules: Original legal text.
