{"data":{"id":"us-ky/krs-67.186","jurisdiction":"us-ky","citation":"KRS 67.186","heading":"Fiscal court may provide for liability and indemnity insurance for benefit of","body":"patients of county operated hospitals -- Conditions.\n(1) The fiscal court of any county in which there is a county operated hospital may\nprovide for liability and indemnity i nsurance for the benefit of the hospital against\nthe negligence of the employees of such hospital.\n(2) The insurance policies so purchased by the fiscal court shall be purchased only from\ninsurance companies authorized to transact business in this state, a nd any such\npolicy shall bind the insurer to pay, subject to the terms and conditions of the\npolicy, any final judgment, not in excess of the policy limits, rendered against the\ninsured hospital or hospital employees for the death or injury of any patient,  or\ndamage to the property of any patient, resulting from the negligence of the hospital,\nits agents or employees.\n(3) This section shall not be construed as waiving the immunity of the county or county\noperated hospital from suit only to the extent of the  policy limits, and no judgment\nmay be enforced or collected against the county, fiscal court, the members thereof,\nor such hospital, but shall only measure the liability of the insurance carrier. No\nattempt shall be made in the trial of any suit to sugges t the existence of any\ninsurance which covers in whole or in part any judgment or award which has been\nrendered in favor of the claimant, but if the verdict rendered by the jury exceeds the\nlimits of applicable insurance, the court shall reduce the amount of said judgment to\na sum equal to the applicable limit stated in the policy.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23709","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:25Z","sha256":"f8e38108fc4405cd53c6bf9b769816e6d420221ebcfc46101c2c4f63a4f1adb5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.185","next":"us-ky/krs-67.190"},"notice":"GroundRules: Original legal text.
