{"data":{"id":"us-ky/krs-67.323","jurisdiction":"us-ky","citation":"KRS 67.323","heading":"Fire department merit system -- Creation -- Scope -- Board -- Definitions --","body":"Applicability.\n(1) Any county that has not established a county police merit system, as provided by\nKRS 78.400 to 78.460 and 78.990 may, by order of its fiscal court, duly m ade and\nentered of record, create a county fire department merit system, and for that purpose\nestablish a county fire department merit board, whose duties it shall be to classify\nand examine applicants seeking employment as firefighters or employees of the  fire\ndepartment of the said county, and, in addition, to promulgate rules and regulations\ngoverning the classification, qualification, examination, appointment, promotion,\ndemotion, fine, suspension and other disciplinary action within the said county fir e\ndepartment of all personnel of the county fire department or departments affected as\nprovided in this section and KRS 67.325 and 78.425, and, in addition thereto, to\nhold such hearings, public and executive, and impose such penalties upon the\npersonnel affected as provided in this section, KRS 67.325 and 78.425.\n(2) Fiscal courts affected hereby shall make appropriations of money for the reasonable\nand necessary expenses of the said board.\n(3) KRS 78.410 to 78.460 and 78.990 shall be followed in the estab lishing of a county\nfire department merit system as provided in this section. All terms referring to the\ncounty police force, by context or definition, shall be taken to mean county fire\ndepartment. Other terms mean:\n(a) \"Board\" means the county fire depar tment merit board created by subsection\n(1).\n(b) \"Chief\" means the chief of the county fire department affected by this section,\nKRS 67.325 and 78.425.\n(c) \"Assistant chief\" means the next in command to the chief of the county fire\ndepartment affected by this section, KRS 67.325 and 78.425.\n(d) \"Secretary\" means the executive secretary and examiner employed by the\ncounty fire department merit board created by this section, KRS 67.325 and\n78.425.\n(e) \"Officer\" means any member of the county fire department a ffected by this\nsection, KRS 67.325 and 78.425.\n(f) \"Employee\" means all other employees of the county fire department affected\nby this section, KRS 67.325 and 78.425.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43620","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:25Z","sha256":"876d8b9967bf0055f9a1f80322c48bee4da2f9226b2c921f25143fa0bc596f27","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.320","next":"us-ky/krs-67.325"},"notice":"GroundRules: Original legal text.
