{"data":{"id":"us-ky/krs-67.374","jurisdiction":"us-ky","citation":"KRS 67.374","heading":"County global positioning monitoring system program -- Request for and","body":"acceptance of public bids -- Monitoring of successful bidder -- Other uses of\nprogram permitted -- Confidentiality of system information.\n(1) \"Global positioning monitoring system\" has the same meaning as in KRS 403.720.\n(2) A county or combination of counties electing to participate in a global positioning\nmonitoring system program shall, by ordinance, set other requirements for global\npositioning monitoring system devices and for  the operation of the global\npositioning monitoring system which shall include, at a minimum, the requirements\ncontained in KRS 403.715 to 403.785, KRS 456.100, the provisions of this section,\nand KRS 67.372.\n(3) A county or combination of counties electin g to participate in a global positioning\nmonitoring system program shall, through a public bid process, select an entity or\nentities to provide the best available technology with regard to global positioning\nmonitoring system devices that meet the requirem ents of this section and KRS\n67.372, 403.761, and 456.100 and a system that meets those same requirements,\nincluding but not limited to the acceptance of reduced fees for petitioners and\nindigent persons ordered to wear a monitoring device.\n(4) A person, c ounty, or combination of counties electing to participate in a global\npositioning monitoring system program shall continuously monitor the performance\nof successful bidders, receive complaints regarding service, and conduct hearings\npursuant to KRS Chapter  13B which may result in penalties as set out in the\ncontract against an entity providing global positioning monitoring system services\nor which may result in cancellation of the contract with the provider of the service,\nor both. The provisions of this su bsection shall be part of any bid offering and any\ncontract entered into between the county or combination of counties and an entity\nproviding global positioning monitoring system services.\n(5) A county or combination of counties electing to operate a glob al positioning\nmonitoring system program may utilize that program for:\n(a) Monitoring a respondent and petitioner pursuant to KRS 403.715 to 403.785\nor 456.100;\n(b) Monitoring the pretrial release of a person charged with a crime pursuant to\nKRS 431.515 to 431.550;\n(c) Monitoring a person assigned to a pretrial diversion program pursuant to KRS\n533.250 to 533.262; and\n(d) Monitoring a person granted probation or conditional discharge pursuant to\nKRS Chapter 533.\n(6) Information obtained by a global position ing monitoring system shall not be a\npublic record.\n(7) Information obtained by a global positioning monitoring system shall be used only\nfor the purpose of verifying the location of the monitored person. Global positioning\nmonitoring system information ob tained from persons subject to monitoring\npursuant to KRS 403.715 to 403.785 or 456.100 shall not be utilized for any\ncriminal investigation, prosecution, or other criminal justice related purpose without\na valid search warrant or order issued by a court o f competent jurisdiction.\nInformation obtained in violation of this subsection or without a valid search\nwarrant or court order shall be inadmissible in court for any purpose.\n(8) Any person or organization who knowingly or wantonly divulges global positioning\nmonitoring system information about any person in violation of subsection (6) or\n(7) of this section shall be guilty of a Class A misdemeanor.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44788","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:26Z","sha256":"af14595419eb4146d7c4451e44a5e836b18953f86ac519b5fc7fffe9ac70aef6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.372","next":"us-ky/krs-67.380"},"notice":"GroundRules: Original legal text.
