{"data":{"id":"us-ky/krs-67.855","jurisdiction":"us-ky","citation":"KRS 67.855","heading":"Ordinance powers -- Conflicts.","body":"(1) Charter county governments may enact and enforce within their territorial limits the\ntax, licensing, police, sanitary, and other ordinances not in conflict with the\nConstitution and general statutes of this state now or hereafter enacted, required for\nthe health, education, safety, welfare, and convenience of the inhabitants of the\ncounty and for the effective administration of the charter county government. A\ncharter county government shall not enact any ordinance that imposes any tax or\nlicense, franchise or other fee, or requires a license, franchise, or other permission,\nfor or with respect to the construction or maintenance of any utility equipment,\nfacility, or apparatus along, over, under, or across the streets, alleys, or public\ngrounds of, or the operation of any utility business within, any portion of the area of\nthe government outside of the larger of the area within the corporate boundaries of\nthe participating city or cities at the time of creation of the charter county\ngovernment, or that part o f the area of the charter county government within which\nthe government provides at least the level of services provided by any participating\ncity that existed prior to the creation of the charter county government.\n(2) Charter county government ordinances  shall be deemed to conflict with general\nstatutes of this state only:\n(a) When the ordinance authorizes that which is expressly prohibited by a general\nstatute; or\n(b) When there is a comprehensive scheme of legislation on the same subject\nembodied in a general statute.\n(3) No ordinance or resolution shall be considered by the charter county government\nlegislative body until it has been read at two (2) separate meetings. A second\nreading may be suspended by a two -thirds (2/3) vote of the membership of the\nlegislative body. Requirements for reading ordinances or resolutions may be\nsatisfied by public reading of the title and summary.\n(4) All ordinances and resolutions shall be effective upon passage, unless timely vetoed\nby the chief executive officer of the  charter county government pursuant to the\nprovisions of the comprehensive plan of the charter county government. Any\nordinance or resolution imposing fines, forfeitures, imprisonment, taxes, or fees,\nother than a bond ordinance or resolution, shall be pub lished in full in a newspaper\nqualified under KRS 424.120. The publication requirements for all other ordinances\nor resolutions, including bond ordinances or resolutions, shall be satisfied by\npublication in full or by publication of the title and summary.\n(5) The provisions of any local, statewide, or nationally recognized standard code and\ncodifications of entire bodies of local legislation may be adopted by ordinance that\nidentifies the subject matter by title, source, and date and incorporates the adopt ed\nprovisions by reference without setting them out in full, if a copy accompanies the\nadopting ordinance and is made a part of the permanent records of the charter\ncounty government.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41119","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"42d56d30e35976bc5147ced2380c032abd60784036faafd06e7a41cd1e7f9e84","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.852","next":"us-ky/krs-67.860"},"notice":"GroundRules: Original legal text.
