{"data":{"id":"us-ky/krs-67.910","jurisdiction":"us-ky","citation":"KRS 67.910","heading":"Unification plan -- Components -- Deadline for completion -- Dissolution of","body":"commission.\n(1) The unification review commission shall study matters relating to the feasibility of\nforming a unified local government and, if unification is proposed, devel op a\nunification plan consistent with the provisions of the Kentucky Constitution and\nKRS 67.900 to 67.940. A unification plan shall include:\n(a) The process for establishing the unified local government;\n(b) A description of the form, structure, functions , and powers of the proposed\nunified local government;\n(c) A description of the officers of the proposed unified local government and\ntheir powers and duties;\n(d) A procedure for the orderly and timely transition of specified services,\nfunctions, and respo nsibilities from each affected city and the county to the\nunified local government;\n(e) A procedure for the orderly transition to the unified local government of the\nservices, functions, and responsibilities of any special district that will be\neliminated;\n(f) A procedure for the orderly transition to the unified local government of the\nservices, functions, and responsibilities of any board, commission, or authority\nthat will be eliminated;\n(g) The procedures by which the unification plan may be amended by the\nsubsequently created unified local government;\n(h) The procedures by which the unification plan may be amended by the\nparticipating county and city or cities as a result of contingencies arising from\nthe failure of certain jurisdictions to vote in favo r of joining the unification\nplan. The contingency plan shall be adopted by the participating county and\ncity or cities by joint ordinance. The contingency plan shall be adopted by the\nparticipating county and city or cities within sixty (60) days of the certification\nof the election result. The contingency plan shall only address:\n1. Issues of revenue;\n2. Issues of indebtedness;\n3. Issues of service provision, service areas, or service area boundaries;\n4. Personnel or administration, but may not infringe upon any pre -existing\ncollective bargaining agreements in force in participating jurisdictions;\nand\n5. Any issues directly related to the cost of government or provision of\nservices within the unification plan.\nThe contingency plan shall not address issues within the plan related to\nparagraph (a), (b), (c), (d), (e), (f), or (g) of this subsection; and\n(i) The procedures by which the unified local government may be dissolved. The\nprocedures drafted shall include but are not limited to:\n1. Requirements for a public petition for the dissolution of the unified local\ngovernment;\n2. The question to be presented to voters for the dissolution of the unified\nlocal government; and\n3. Any administrative measures neces sary to settle tax and debt issues\ncreated by the dissolution of the unified local government.\nThe proposed unification plan shall specify that no petition for the dissolution\nof the unified local government shall be valid until a period of five (5) years\nhas passed from commencement of the first terms of the duly elected officers\nof the unified local government; and\n(j) Such other provisions as the commission shall determine.\n(2) The unification review commission may propose a unification plan under which  the\ncounty and one (1) or more participating cities unite to form a single unit of local\ngovernment.\n(3) The unification plan shall be completed within two (2) years of the commission's\nappointment. If a majority of the commission members are unable to agree on a plan\nfor unification within the two (2) year period, the unification review commission\nshall be dissolved by operation of law.","path":["KRS Chapter 67"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41120","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"52f598d21a1d4bd05c17113f08ef2a684e81135ef119d943eb031bbba8ce0798","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67.908","next":"us-ky/krs-67.912"},"notice":"GroundRules: Original legal text.
