{"data":{"id":"us-ky/krs-67a.205","jurisdiction":"us-ky","citation":"KRS 67A.205","heading":"Employment of retired police officers -- Eligibility -- Requirements.","body":"(1) As used in this section \"police officer\" has the same meaning as in KRS 15.420.\n(2) Subject to the limitations of subsection (7) of this section, the legislative body of\nthe urban-county government may employ, as needed, individuals as police officers\nunder this section who have retired from the Police and Fire Retirement Fund\nestablished by KRS 67A.360 to 67A.690.\n(3) To be eligible for employment under this section, an individual shall have:\n(a) Participated in the Law Enforcement Foundation Program fund under KRS\n15.410 to 15.510;\n(b) Retired on a service retirement annuity under the provisions of KRS 67A.410;\n(c) Been separated from service for a period of not less than thirty (30) days;\n(d) Retired with no administrative charges pending; and\n(e) Retired with no preexisting agreement or arrangement between the individual\nand the urban -county government prior to the individual's retirement for the\nindividual to return to work for the urban-county government.\n(4) Individuals employed under this section shall:\n(a) 1. Serve for a term not to exceed one (1) year.\n2. The one (1) year employment term may be renewed annually at the\ndiscretion of the employing urban-county government;\n(b) Receive compensation according to the standard procedures applicable to the\nemploying urban-county government; and\n(c) Be employed based upon need as determined by the employing urban -county\ngovernment.\n(5) Individuals employed under this section:\n(a) Shall continue to receive all retirement and health insurance benefits to which\nthey were entitled under the provisions of KRS 67A.345 and 67A.360 to\n67A.690;\n(b) 1. Shall be subject to any merit system, civil service, or other legislative\ndue process provisions applicable to the employing urban -county\ngovernment.\n2. A decision not to renew a one (1) year appointment term under this\nsection shall not be considered a retaliatory action, disciplinary action,\nor deprivation subject to due process; and\n(c) Shall not be eligible to receive additional health insurance coverage through\nthe employing urban-county government beyond the health insurance  benefits\nprescribed for retirees in KRS 67A.345.\n(6) The employing urban -county government shall not make any employment\nretirement contributions for retired police officers employed pursuant to this section\nto any government pension plan authorized under KRS Chapter 67A.\n(7) The number of retirees hired by an urban -county government under this section\nshall not exceed the greater of:\n(a) Twenty-five (25) police officers; or\n(b) A number equal to ten percent (10%) of the police officers employed by the\nurban-county government in the immediately preceding calendar year.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53535","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"b88f33400a5b83e6b24a4ab9d46473f4dd3bb4b954edaaf4f91748e40c2a6588","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.200","next":"us-ky/krs-67a.210"},"notice":"GroundRules: Original legal text.
