{"data":{"id":"us-ky/krs-67a.210","jurisdiction":"us-ky","citation":"KRS 67A.210","heading":"Definitions.","body":"(1) In KRS 67A.210 to 67A.350, unless the context requires otherwise:\n(a) \"Administrative or directorial position\" means the head of a department or\nother executive unit other than those excluded under KRS 67A.220.\n(b) \"Appointing authority\" means the officer,  commission, board or body having\nthe power of appointment or removal in any office, department, commission,\nboard or institution, under law, ordinance or comprehensive plan, and does\nnot include any ratifying authority entitled to approve or disapprove an\nappointment.\n(c) \"Civil service\" means the offices and positions of trust or employment in the\nservice of the urban -county government not specifically excluded by KRS\n67A.220 to 67A.340.\n(d) \"Commission\" means the civil service commission as established u nder KRS\n67A.230.\n(e) \"Comprehensive plan\" means the plan for merger of local governments\nprovided in this chapter.\n(f) \"Competitive examination\" means the examination or evaluation described in\nKRS 67A.230 and 67A.240.\n(g) \"Dismissal\" means the discharge of an employee.\n(h) \"Employee\" means any person employed in the conduct of municipal affairs\nincluding an administrative or directorial position, but the term shall not\ninclude:\n1. Officers elected by the voters, and persons appointed to fill vacancies in\nelective offices;\n2. Members of all boards, commission and authorities established under\nthe provisions of the comprehensive plan or by ordinance pursuant\nthereto;\n3. The chief administrative officer as denominated in the comprehensive\nplan;\n4. Department commissioners of all executive departments created by the\ncomprehensive plan or by ordinance pursuant thereto;\n5. All administrative assistants appointed by the mayor or highest elective\nexecutive officer under the provisions of the comprehensiv e plan and all\nsecretaries excluded by the provisions of the comprehensive plan;\n6. Temporary or part-time employees and all persons employed to conduct\nspecial inquiries, investigations or studies for the urban -county\ngovernment;\n7. Constitutional officers and their appointees.\n(i) \"Pension fund\" means the moneys derived from the employees or the levy of a\nspecial tax, or any other sum derived from any other source, to be used for the\nretirement of employees after the prescribed years of service and for th e\nbenefit of disabled employees, and widows and dependent children in the case\nof death of an employee within the scope of his employment according to the\nterms of KRS 67A.320 through 67A.340, the comprehensive plan, or the\nordinances of the urban -county g overnment, including retirement systems\nadopted pursuant to law.\n(j) \"Seniority\" for purposes of KRS 67A.240, 67A.250, and 67A.270 refers to\nlength of service as defined in the comprehensive plan or ordinance, but shall\nin each case include such service un der cities, counties or other municipalities\nwhich have been merged into the urban -county government. Seniority and\nlength of service for purposes of KRS 67A.320 and 67A.330 shall be in\naccordance with rules established by the comprehensive plan or ordinance, but\nshall in each case include service or seniority obtained under pension plans\ndescribed in such sections existing in municipalities prior to the adoption of\nurban-county government, and shall in no case give credit to any service or\nseniority except in respect to such prior service in municipalities having such\npension plans, or under urban -county governments, except that the urban -\ncounty government may purchase credits in lieu of seniority, the cost thereof\nbeing determined by the trustees of the pe nsion fund, in accordance with\nsound actuarial principles, for employees whose seniority or length of service\nwas under municipalities other than those described herein.\n(2) The provisions of KRS 67A.230 to 67A.340 are independent of and do not affect\nthe laws governing the police and fire departments, nor their pension funds.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23854","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"8305765a99d05e4af3d7ff9e88e8cb208e10b1a4cd3464fde0a0fe48124daa49","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.205","next":"us-ky/krs-67a.220"},"notice":"GroundRules: Original legal text.
