{"data":{"id":"us-ky/krs-67a.240","jurisdiction":"us-ky","citation":"KRS 67A.240","heading":"Examinations -- Rating -- Eligible list -- Administrative regulations.","body":"(1) The civil service commission shall prescribe and propound such said examinations\nas are proper, commensurate with vacant positions within the various departments\nof the urban -county government, according to classification prescribed by\nordinance, shall  set such times and places for holding examinations as may be\nproper and shall give public notice of vacancies by publication pursuant to KRS\nChapter 424, and shall give actual notice to all eligible applicants of time and place\nof examinations. Provided, however, that the civil service commission may\nprescribe and propound job descriptions which reasonably establish minimum\nqualifications and standards for eligibility to take such examinations, but in no\nevent shall such job descriptions be a subterfuge fo r the evasion of the requirement\nthat employment be determined on the basis of the principles set out herein.\n(2) The civil service commission shall, as soon after examinations as is practicable,\ncertify to the appointing authority, a list of the applicant s so examined, with the one\nhaving the highest average ranked first, and all others ranked numerically according\nto the result of the examination. After the compilation of such a list the commission\nmay provide for further, substantially identical examinat ions, given on the same\nbasis as the original examination, to supplement the list so compiled, and the results\nof each such subsequent examination shall be consolidated with the results of the\nprior examinations to provide an eligible list from among all o f those who have\ntaken such several examinations.\n(3) Every soldier, sailor, marine, members of the air forces, Army Nurses Corps and\nmembers of other branches of the military services and Red Cross nurses who\nserved during a period of hostilities between the United States and another power in\nWorld War II, the Korean or Vietnam conflict, the Persian Gulf War, Operation\nIraqi Freedom, or Operation Enduring Freedom, who has not been dishonorably\ndischarged, and who is an applicant for any position of civil s ervice of the urban -\ncounty government shall be entitled to five percent (5%) increase on his\nexamination mark on entrance into civil service employment.\n(4) The civil service commission of urban -county governments shall maintain an\neligible list of all ind ividuals who, based on the outcome of examinations, are\nqualified for each position to be filled.\n(5) The legislative body may designate certain civil service positions and prescribe that\nfor such positions the examinations shall first be given exclusively  to current\nemployees; provided, however, that if no employee with a minimum of six (6)\nmonths' seniority achieves a passing grade, an examination shall be held in\naccordance with subsection (1) of this section, and shall be held, if less than five (5)\nsuch persons achieve a passing grade if the appointing authority so determines.\n(6) Upon the approval of the civil service commission, the appointing authority may\npromulgate administrative regulations to carry out the provisions of this section.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42592","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"08dba1ef3c967894a3f63ac0ffddc754a1972ac6ca3468129ea1a3e6218de772","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.230","next":"us-ky/krs-67a.250"},"notice":"GroundRules: Original legal text.
