{"data":{"id":"us-ky/krs-67a.290","jurisdiction":"us-ky","citation":"KRS 67A.290","heading":"Appeal to Circuit Court and Court of Appeals.","body":"(1) Any employee of the urban -county government found guilty by the civil service\ncommission of any charge as provided by KRS 67A.280 or any action upheld under\nsubsection (7) of the said section, or any amendment thereto, may appeal to the\nCircuit Court of the county in which the urban-county government is located within\nthirty (30) days after such action becomes final, but the enforcement of the\njudgment of the civil service commission shall not be suspended pending appeal.\n(2) Upon request in writing by the accused and the payment of costs therefor, the\nsecretary of the civil service commission shall file a certified copy of the charges\nand the judgment of that body in the Circuit Court. Upon the transcript being filed\nthe case shall be docketed in the Circuit Court and tried de novo.\n(3) If the secretary fails to certify the transcript to the Circuit Court within five (5) days\nafter the request is made, then the aggrieved person may file an affidavit in that\ncourt setting out as fully as possible the charges made at the time of trial and\njudgment, together with a statement that demand for the transcript had been made of\nthe secretary more than five (5) days prior to the filing of the affidavit. Upon filing\nof this affidavit in the Circuit Court, the case shall  be docketed in that court and the\ncourt may compel the filing of the transcript by the secretary by entering proper\nmandatory order, and upon failure of the secretary so to do, he shall be liable to fine\nand imprisonment for contempt. Such appeal shall ha ve precedence over other\nbusiness and be determined speedily.\n(4) An appeal will lie from the judgment of the Circuit Court to the Court of Appeals as\nin other cases, if the original punishment fixed by the civil service commission was\ndismissal of the acc used. An appeal will also lie from the judgment of a Circuit\nCourt in any controversy arising under this section or any other section of the\nstatutes relating to civil service for urban-county governments.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23862","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"7e44ce9aeab1ec02c3f01fb64b48ee15e87925bc8215ccedb2079296bcb03a08","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.280","next":"us-ky/krs-67a.300"},"notice":"GroundRules: Original legal text.
