{"data":{"id":"us-ky/krs-67a.300","jurisdiction":"us-ky","citation":"KRS 67A.300","heading":"Number of employees -- Salaries -- Protection from dismissal, suspension,","body":"or reduction -- Abolishment of office or position -- Reinstatement.\n(1) The urban -county legislative body shall fix by ordinance the number and\nclassification of urban -county em ployees, and the salaries for each classification.\nWhen the number of employees and their classification has been fixed by\ncomprehensive plan or ordinance, including any ordinance of a city or other\nmunicipality existing prior to the adoption of the urban -county form of government,\nwhich prior ordinance is adopted for any period of time by the urban -county\ngovernment under its comprehensive plan or ordinance, no employee shall be\ndismissed, suspended or reduced in grade or pay for any reason except that set  out\nin KRS 67A.280.\n(2) Provided, further, that: whenever in the exercise of a reasonable discretion, it shall\nbe the judgment of the legislative body of the urban -county government that\neconomic necessity requires it, or that there is no longer a need fo r a particular\noffice or position to exist, the legislative body may abolish said office or position\nand any officer or employee occupying said office or position may be laid -off or\nsuspended until and if such office or position is re -created or reestablis hed. The\nabolition of any office or position must not be a subterfuge to effect another\npurpose, but must be actual and bona fide and must not amount to the mere\nalteration, modification or abolition of title only.\n(3) Should any officer or employee conceive that he has been aggrieved by the abolition\nor the proposed abolition of said office or position, he may, at any time within\nninety (90) days, file a petition in the Circuit Court of the county wherein the urban-\ncounty government is located, stating his reason why it should not be abolished, and\nupon issue joined thereon by the urban -county government, the burden shall be on\nthe latter to establish the necessity for and the good faith of the urban -county\ngovernment in abolishing said office or position. The right to abolish and the right\nto have the office or position re -created shall be determined as other equitable\nactions are determined.\n(4) If the office or position is re -created or reestablished within one (1) year, then any\nperson who was deprived o f his office or position shall be restored to the office or\nposition he formerly held or occupied in the order of his seniority if he shall elect to\ndo so, and the urban-county government shall advise said officer or employee at his\nlast known address and advertise pursuant to KRS Chapter 424, that the office or\nposition has been re-created or reestablished.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23863","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"4ae32cbf7dae8bf47cd91a520b0edf80697d29fbdb177c2917c2e728a006f174","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.290","next":"us-ky/krs-67a.310"},"notice":"GroundRules: Original legal text.
