{"data":{"id":"us-ky/krs-67a.345","jurisdiction":"us-ky","citation":"KRS 67A.345","heading":"Continued  health insurance eligibility for retirees -- Benefits --","body":"Payments  made  to provider -- Group rates for spouses, dependents, and\ndisabled children.\n(1) All members  of the fund operated pursuant to KRS 67A.360 to 67A.690, and all\nmembers  of the urban-county government city employees pension fund who\nretired prior to July 1, 1999, and who did not terminate their participation in the\ngroup health insurance plan provided by the urban-county government before\nthat date, and all members  who retire on or after July 1, 1999, or who withdrew\nfrom service on a certificate prior to September 18, 2002, or who withdraw on a\ncertificate as provided by KRS 67A.410(3)(a) or (b), shall continue to be eligible\nto participate, at the member's cost, in a group health insurance plan approved\nby the urban-county council for such retirees.\n(2) The urban-county government shall provide, on behalf of all eligible members\nof the fund operated pursuant to KRS  67A.360 to 67A.690 and city employees\npension, the following benefits:\n(a) A sum equal to the single premium for the plan coverage selected by the\nretiree, but not more  than one  hundred  percent (100%)  of the\nurban-county  government's  contribution to  the  health insurance\ncomponent  of the benefit pool for current urban-county government\nemployees; and\n(b) Upon  the death of a member  of the fund operated pursuant to KRS\n67A.360 to 67A.690 that is due to occupational causes, the urban-county\ngovernment  shall pay to the approved provider of the group health\ninsurance plan one hundred percent (100%) of the cost of the family\nmedical coverage for the member's surviving spouse and dependent\nchildren as long as they remain eligible for a  monthly retirement\nallowance from the retirement fund.\n(3) No  benefits shall be available under this section to retired members  who were\nnot, immediately prior to July 1, 1999, participants in the group health\ninsurance plan coverage provided to urban-county government employees and\nretirees or who  retire on or after July 1, 1999, and, at the time of their\nretirement, do not elect to participate in the group health insurance plan\ncoverage provided pursuant to subsection (1) of this section.\n(4) Benefits shall be available under this section to members  of the fund operated\npursuant to KRS 67A.360 to 67A.690 who:\n(a) Prior to September 18, 2002, withdrew from service on a certificate when\nthey attain the age of forty-six (46) years if, at the time they withdrew from\nservice, they elected to participate in the group health insurance plan\ncoverage  provided pursuant to subsection (1) of this section upon\nattaining age forty-six (46);\n(b) Withdraw on a certificate entitling them to a pension benefit at the age of\nforty-one (41) as provided by KRS  67A.410(3)(a) if, at the time they\nwithdraw from service, they elect to participate in the group health\ninsurance plan coverage provided pursuant to subsection (1) of this\nsection upon attaining age forty-one (41); or\n(c) Withdraw on a certificate entitling them to a pension benefit at the age of\nfifty (50) as provided by KRS  67A.410(3)(b) if, at the time they withdraw\nfrom service, they elect to participate in the group health insurance plan\ncoverage  provided pursuant to subsection (1) of this section upon\nattaining age fifty (50).\n(5) All payments shall be made  to the approved provider of the group health\ninsurance plan, not to the retiree, and the retiree shall not be entitled to receive\nany portion of the government contribution remaining after payment is made to\nthe approved provider.\n(6) Group  rates under the group health insurance plan approved  by  the\nurban-county council under subsection (1) of this section shall be made\navailable to the spouse, dependents, and disabled children, regardless of the\ndisabled child's age, of a qualified and participating retiree, if the premium for\nthe spouse, dependent, or disabled child is paid by the retired member,\nspouse, dependent, or disabled child, by payroll deduction or similar method.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52304","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"f0b5f88d9056fadcae0a106ca2f48766c0ca1f899db134bb117dd441683fb2e4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.340","next":"us-ky/krs-67a.350"},"notice":"GroundRules: Original legal text.
