{"data":{"id":"us-ky/krs-67a.404","jurisdiction":"us-ky","citation":"KRS 67A.404","heading":"Purchase of retirement credit for accumulated unused sick leave.","body":"(1) Any member who retires based on age and service on or after January 1, 1990, or\nbased on service on or after September 18, 2002, may purchase service credit for\nunused sick leave accrued while contributing to the retirement fund from which the\nretirement benefit is to be paid in accordance with this section.\n(2) A member retiring based on age and service, or based on service only, on or after\nSeptember 18, 2002, who chooses to purchase service credit for unused,\naccumulated sick leave as provided in this se ction shall notify the board of his or\nher intention upon submitting his or her retirement application to the board. The\nurban-county government shall certify the retiring member's unused, accumulated\nsick leave balance, up to a maximum of seven hundred an d twenty (720) hours for\nmembers employed by the division of police and one thousand and eight (1,008)\nhours for members employed by the division of fire. The member's sick leave\nbalance, expressed in days, shall be divided by the average number of working  days\nper month and rounded to the nearest number of whole months. This number of\nmonths shall be added to the member's service credit for the purpose of determining\nhis or her rate of retirement annuity pursuant to KRS 67A.430 and his or her total\nservice credit pursuant to KRS 67A.400. The value of the unused, accumulated sick\nleave shall be based on the daily salary rate calculated from the member's last\nannual salary. Payment for unused sick leave, up to a maximum of seven hundred\nand twenty (720) hours  for members employed by the division of police and one\nthousand and eight (1,008) hours for members employed by the division of fire,\nshall be incorporated into the annual salary of the final year of service, provided that\nthe member contributes to the retirement fund the amount set forth in KRS 67A.510\nand the urban-county government matches such contribution by the amount set forth\nin KRS 67A.520(1) on the unused, accumulated sick leave.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23877","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"93418e192ac549f8a079bc840446f9ec812455f857cdcf32e50f51595318312a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.402","next":"us-ky/krs-67a.406"},"notice":"GroundRules: Original legal text.
