{"data":{"id":"us-ky/krs-67a.470","jurisdiction":"us-ky","citation":"KRS 67A.470","heading":"Total and permanent disability not occasioned by duties of member --","body":"Benefits.\n(1) (a) Upon total and permanent disability of a member as the result of any cause\nother than occupational disability, if a member shall have rendered at least\nfive (5) yea rs of total service, he shall be entitled to a disability retirement\nannuity determined under this section.\n(b) For a member whose participation date in the fund is prior to March 14, 2013,\nthe amount of the disability retirement annuity shall be equal to two and one-\nhalf percent (2.5%) of the average salary, as defined in KRS 67A.360(13), for\neach full year of total service, subject to a minimum payment of twenty -five\npercent (25%) of such average salary and a maximum payment of seventy-five\npercent (75%) of average salary.\n(c) For a member whose participation date in the fund is on or after March 14,\n2013, the amount of the disability retirement annuity shall be equal to two and\none-quarter percent (2.25%) of the average salary, as defined in KRS\n67A.360(13), for each full year of total service, subject to a minimum\npayment of twenty -two and one -half percent (22.5%) of such average salary\nand a maximum payment of sixty -seven and one -half percent (67.5%) of\naverage salary.\n(d) Payment of the disability annui ty as provided by this section shall be made\nduring disability of the member. After the member's death, his eligible widow,\nif any, shall receive the benefits as provided in KRS 67A.492, and his minor\nchildren, if any, shall receive benefits as provided under KRS 67A.450.\n(2) Any annuity for nonoccupational disability shall begin to accrue upon the expiration\nof ninety (90) days following the commencement of disability provided that if the\nmember is receiving salary for sick leave for a period of more than ninety (90) days,\npayment shall accrue from the date such salary ceases. If written application for\nsuch annuity shall not have been filed with the board prior to the expiration of\nninety (90) days from date of disability, the annuity shall begin to accrue  from the\ndate the application shall be filed but not prior to the expiration of ninety (90) days\nfrom the date of disability, nor in any event prior to the time when salary payments\nto the employee shall have ceased.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41664","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"43f23806791f767f4f5bb0da164d9c8ccb3eb8614ead3e9d9c79189582ad5867","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.462","next":"us-ky/krs-67a.480"},"notice":"GroundRules: Original legal text.
