{"data":{"id":"us-ky/krs-67a.480","jurisdiction":"us-ky","citation":"KRS 67A.480","heading":"Medical examination to determine disability -- Certification of","body":"examining physicians -- Rehearing or judicial review.\n(1) For the purpose of KRS  67A.360 to 67A.690, a member  shall be considered\ntotally and  permanently disabled after the board has  received written\ncertification by at least two (2) licensed and practicing physicians selected by\nthe board that the member  is totally and likely to be permanently disabled for\nthe further performance of the duties of any assigned position in the service of\nthe department.\n(2) For members  who make an application for total and permanent occupational\ndisability, at least two (2) licensed and practicing physicians selected by the\nboard must also certify in writing that the member's disability is due to an\noccupational cause. If such physicians do not concur as to whether the\nmember's  disability is due to an occupational cause, the board may, with the\nconsent of the member,  grant the member  a disability retirement due to a\ncause other than occupational disability under the provisions of KRS 67A.470.\n(3) If upon  consideration of the report of such physicians as provided by\nsubsections (1) and (2) of this section and such other evidence as shall have\nbeen  presented to it by the member  or others interested therein, the board\nfinds the member  to be totally and permanently disabled, it shall grant him a\ndisability retirement annuity upon written certification that the member  has\nbeen separated from the service of the government because of total disability\nof such nature as to reasonably prevent further service for the employer, and\nas a consequence is not entitled to compensation from the government.\n(4) Nothing contained in this section shall be construed to limit the ability of a\nmember  to seek a rehearing in accordance with KRS 67A.660 or judicial review\nin accordance with KRS  67A.670 of a disability determination or calculation of\na disability retirement annuity by the board.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52309","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:27Z","sha256":"a8881df46c73fa6fae0b7dd51a1326761e2b5e07c9cd1b00f0478b17b7112ac4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.470","next":"us-ky/krs-67a.490"},"notice":"GroundRules: Original legal text.
