{"data":{"id":"us-ky/krs-67a.6904","jurisdiction":"us-ky","citation":"KRS 67A.6904","heading":"Activities prohibited and duty to bargain in good faith.","body":"(1) Except as provided in KRS  336.130, urban-county governments and their\nrepresentatives and agents are prohibited from:\n(a) Interfering, restraining, or coercing police officers, firefighter personnel,\nfirefighters, or corrections personnel in the exercise of the rights\nguaranteed in KRS 67A.6902;\n(b) Dominating or interfering with the formation, existence, or administration\nof any labor organization;\n(c) Discriminating in regard to hiring or tenure of employment or any term or\ncondition of employment to encourage or discourage membership in any\nlabor organization;\n(d) Discharging or otherwise discriminating against an employee because he\nor she has signed or filed any affidavit, petition, or complaint or given any\ninformation or testimony under this section; or\n(e) Refusing to bargain collectively in good faith with a labor organization\nwhich is the exclusive representative of employees in an appropriate unit,\nincluding but not limited to the discussing of grievances with the exclusive\nrepresentative.\n(2) Labor organizations and their agents are prohibited from:\n(a) Restraining or coercing:\n1. Police officers, firefighter personnel, firefighters, or corrections\npersonnel in the exercise of the right guaranteed in KRS  67A.6902;\nand\n2. An urban-county government in the selection of a representative for\nthe  purposes  of collective bargaining or the adjustment of\ngrievances; or\n(b) Refusing to bargain collectively in good  faith with an urban-county\ngovernment,  if they have  been  designated in accordance with the\nprovisions of this section as the exclusive representative of police officers,\nfirefighter personnel, firefighters, or  corrections personnel in an\nappropriate unit.\n(3) For the purposes of this section, to bargain collectively is to carry out in good\nfaith the mutual obligation of the parties, or their representatives; to meet\ntogether at reasonable times, including meetings  in advance  of the\nbudget-making process; to negotiate in good faith with respect to wages,\nhours, and other conditions of employment; to negotiate an agreement; to\nnegotiate any question arising under any agreement; and to execute a written\ncontract incorporating any agreement reached, if requested by either party.\nThe  obligation shall not be interpreted to compel either party to agree to a\nproposal, or require either party to make a concession.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45471","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:28Z","sha256":"b236c4ca7fbedeeb65815b60121cbb508a550da16be335814347e4d1df8f6c66","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.6903","next":"us-ky/krs-67a.6905"},"notice":"GroundRules: Original legal text.
