{"data":{"id":"us-ky/krs-67a.845","jurisdiction":"us-ky","citation":"KRS 67A.845","heading":"Purchase of development rights program.","body":"(1) Within one hundred eighty (180) days following the passage of a purchase of\ndevelopment rights proposal by referendum as provided for in KRS 67A.843,\n67A.847, and 67A.849, an urban -county government shall establish a purchase of\ndevelopment rights program which, in addition to the matters approved by\nreferendum, shall include:\n(a) A statement of the purpose of the program;\n(b) A detailed map showing the locations of the properties from which\ndevelopment rights may be purchased;\n(c) The restrictions upon the  use and development of the properties from which\ndevelopment rights have been purchased, and the duration of those restrictions\nwhich may be perpetual as the equivalent of covenants running with the land;\n(d) The mechanism, if any, for removing the restrictions;\n(e) The procedure for valuation and transfer of the development rights. The\ninstrument of transfer shall be an instrument drawn, executed, and recorded in\naccordance with KRS Chapter 382, which shall set forth the terms of the\nrestrictions with specificity;\n(f) The entity authorized by the urban-county government to operate the program;\nand\n(g) Any other provisions the urban -county government deems necessary or\nappropriate.\n(2) The program may provide for the purchase of conservation easements or ot her\ncomparable interests in real estate in addition to or in lieu of the purchase of\ndevelopment rights.\n(3) The provisions of the program, except those elements adopted by referendum, may\nbe amended from time to time by the urban-county government.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23949","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:28Z","sha256":"44d0089da8af0a5b63f69de7f9070bf9c180c3bb2e6f84aebede01fe28b78c4b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.843","next":"us-ky/krs-67a.847"},"notice":"GroundRules: Original legal text.
