{"data":{"id":"us-ky/krs-67a.871","jurisdiction":"us-ky","citation":"KRS 67A.871","heading":"Definitions for KRS 67A.872 to 67A.894.","body":"As used in KRS 67A.872 to 67A.894, the following words or terms shall have the\nrespective meanings indicated, unless a different meaning is clearly indicated by the\ncontext:\n(1) \"Assessed value basis\" means the plan for the levying of improvement benefit\nassessments upon benefited property for benefits conferred by construction of\nprojects on the basis of the assessed values (land only) of the benefited property,\nwhether such levies are paid in full by benefited property owners or levied annually\nto amorti ze bonds.  Such plan shall also include the levying of identical\nimprovement benefit assessments upon classified zones of benefited property where\ndetermination is made by ordinance of an urban -county government, as provided in\nKRS 67A.872 to 67A.894, that  benefits conferred by construction of a project are\nsubstantially equal and that the assessed value (land only) of all benefited property\nor designated zones thereof shall therefore be deemed equal in respect of a given\nwastewater collection project.\n(2) \"Benefited property, and property to be benefited\" mean the property (land only)\nproposed to be benefited by construction of a wastewater collection project\ninstituted by an urban -county government for the payment of the costs of which\nimprovement benefit assessments are to be levied against and collected from such\nbenefited property.\n(3) \"Bonds\" mean improvement lien bonds authorized and issued by urban -county\ngovernments pursuant to authority of KRS 67A.872 to 67A.894 for the purpose of\nproviding costs for the construction of wastewater collection projects.\n(4) \"Construction\" means and includes, the following services and facilities provided\nby an urban-county government:\n(a) Preliminary planning to determine the economic and engineering feasibility of\nconstruction of wastewater collection projects, any engineering, architectural,\nlegal, fiscal and economic investigations and studies necessary thereto, and all\nnecessary surveys, designs, plans, working drawings, specifications,\nprocedures and other requ ired actions incident to the construction of\nwastewater collection projects;\n(b) The building, acquisition, installation, erection, alteration, remodeling,\nimprovements, expansion or extension of wastewater collection projects, and\nany other physical devices or appurtenances in connection with, or reasonably\nattendant to, such projects;\n(c) The provision or making available sewer collection services to benefited\nproperty by providing sewer facilities to such benefited property although not\ndirectly financed by the issuance of bonds; and\n(d) Inspection and supervision incident to the acquisition, construction and\ninstallation of wastewater collection projects.\n(5) \"Costs\" as such term shall be applied to any wastewater collection project\nundertaken under KRS 67A.872 to 67A.894 includes the cost of labor, materials\nand equipment necessary to acquire, install and complete the project in a\nsatisfactory manner, cost of land acquired, and every expense connected with the\nproject, including construction costs, p reliminary and other surveys, financial\nplanning, inspections of the work as construction progresses, engineers' fees and\ncosts, preparation of plans and specifications, publication of ordinances and notices,\ninterest which will accrue on the bonds until t he due date of the first annual\nimprovement assessment levied in connection therewith, capitalized interest on the\nbonds for a period not to exceed three (3) years, a sum equal to any discount in the\nsale of the bonds (if discount bids are authorized and p ermitted by the issuing\ngovernment), all or any portion of the debt service reserve requirement, if\ndetermination is made to finance them from bond proceeds, a reasonable allowance\nfor unforeseen contingencies, the printing of bonds and other costs of fina ncing,\nincluding payment of attorneys' fees, underwriting and fiscal agency fees, trustees'\nfees, rating service fees and costs of issuance of bonds.\n(6) \"Debt service reserve requirement\" means, with respect to any particular issue of\nbonds, the maximum annual requirements for payment of principal of and interest\non the bond issue, which debt service reserve requirement shall be either funded in\nwhole or in part by application of bond proceeds, or accrued in due course by the\nlevying of improvement benefi t assessments as provided in KRS 67A.872 to\n67A.894.\n(7) \"Government or urban -county government\" means an urban -county government\nwhich has been duly created and established pursuant to the provisions of this\nchapter.\n(8) \"Ordinance\" means a formal and b inding enactment of the urban -county council of\nan urban -county government entered in connection with the financing by such\ngovernment of a wastewater collection project.\n(9) \"Public ways\" shall  include streets, boulevards, avenues, roads, lanes, alleys,\nparkways, courts, terraces and other courses of travel open to the general public by\nwhatsoever name designated.\n(10) \"Wastewater\" means any water or liquid substance contain ing sewage, industrial\nwaste or other pollutants or contaminants derived from the prior use of such water\nor liquid substance.\n(11) \"Wastewater collection project or projects\" means all or any part of any facilities,\ndevices, objects and systems used and useful in the collection, holding or\ntransmission of wastewater from a benefited property to wastewater treatment\nplants or other similar facilities for final disposition thereof.  Such terms shall\ninclude, without limiting the generality of the foregoing,  sanitary sewage collection\nlines, intercepting sewers, outfall sewers, sewer laterals, power stations and\npumping stations, and other equipment and their appurtenances necessary to enable\nthe project to fulfill its function, including land acquisition, wh ether such project\nfacilities are provided by funds derived from issuance of bonds or otherwise\nprovided by a government in any manner.","path":["KRS Chapter 67A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23954","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:28Z","sha256":"c482c3951b5f80c15ef3b36fa85e978c5746027e390db1cb9da72d5254d10108","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67a.860","next":"us-ky/krs-67a.872"},"notice":"GroundRules: Original legal text.
