{"data":{"id":"us-ky/krs-67a.918","jurisdiction":"us-ky","citation":"KRS 67A.918","heading":"Duties of commissioners.","body":"The board of commissioners shall:\n(1) Study the need for new parking facilities within the urban -county and report the\nresults of such study to the legislative body.\n(2) Study the need for parking space to be provided without charge to certain classes of\nusers within one or more districts of the urban-county and report the results of such\nstudy to the legislative body.\n(3) If the authority finds a need for one or more parking districts it may make a report\nwhich shall:\n(a) Describe the outside boundaries of the proposed local parking distric t giving\ndue consideration to benefit rendered to each parcel or tract of real estate so\nincluded.\n(b) Describe the boundaries within the proposed parking district or such\nsubdistricts as may be required to properly adjust for various degrees of\nbenefit to each subdistrict within the local parking district.\n(c) Propose parking facilities or structures to be acquired or constructed and give\nthe expected cost of such facilities.\n(d) Propose a plan of assessment or taxation or both to be imposed on business es,\nprofessions, and real estate located within the proposed parking district\nconsistent with the fiscal needs of the district.\n(4) The authority shall report the results of its study to the legislative body, describing\nthe outside boundaries of the area to be benefited, the nature and extent of benefit,\nthe nature and cost of the facilities proposed, and the details of the plan of\nassessment or taxation, or both, proposed to be imposed on businesses, professions,\nand real estate located within the propose d parking district. If the legislative body\nfinds that the general plan is in the public interest, the legislative body shall set by\nresolution a time and place for a first public hearing on the proposal.  A notice of\nthe time and place of the hearing, inc luding the complete text of the report of the\nauthority to the legislative body, shall be published pursuant to KRS Chapter 424.\nThe hearing shall be held before the legislative body, with the mayor presiding.\n(5) After the public hearing the legislative body may:\n(a) By resolution determine that no local parking district is in the best interests of\nthe urban-county government.\n(b) Resubmit the original study and report to the authority with directions to make\nspecific changes.\n(c) Make such changes to the proposed boundaries of the district and subdistricts\n(if any) as may be deemed necessary and make such changes to the proposed\nad valorem tax rates or occupational taxes as may be found necessary in\nkeeping with the revenue needs of the district and t he benefit expected to be\nderived to the various recipients.
