{"data":{"id":"us-ky/krs-67c.305","jurisdiction":"us-ky","citation":"KRS 67C.305","heading":"Membership of merit board -- Appointment -- Removal -- Oath -- Election","body":"of police officers.\n(1) The mayor, subject to the approval of the legislative council of the consolidated\nlocal government, shall appoint five (5) persons, who shall constitute th e\nconsolidated local government police force merit board of the consolidated local\ngovernment. The members of the board shall serve without compensation. Each\nboard appointee shall be at least thirty (30) years of age, a resident of the\nconsolidated local government, and not related by either blood or marriage to either\nthe mayor or any member of the legislative council of the consolidated local\ngovernment. The first members of the board shall be appointed within thirty (30)\ndays of the effective date of the ordinance creating a consolidated local government\npolice force merit system and merit board. One (1) member of the board shall be\nappointed for a term of one (1) year, one (1) for a term of two (2) years, two (2) for\na term of three (3) years, and one ( 1) for a term of four (4) years. Thereafter, all\nappointments shall be for four (4) years except that an appointment to fill a vacancy\non the board shall be made only for the unexpired term of the vacated position. Any\nboard member may be removed by resolu tion of the legislative council of the\nconsolidated local government for neglect, incapacity, misfeasance, or malfeasance\non the part of a board member. No appointed board member shall hold any other\npublic office, elective or appointive, during his or her  term as a member of the\nboard, and shall not receive any money, gift, or consideration of any type from any\nperson, directly or indirectly, for or on account of any recommendation, proposal, or\nsuggestion bearing upon the business of the board or the cons olidated local\ngovernment police force. Not more than three (3) members shall be members of the\nsame political party.\n(2) Each appointee, before entering upon the discharge of his or her duties, shall qualify\nby subscribing, taking, and filling an oath of office as required by law.\n(3) The officers of the consolidated local government police forces shall elect, for a two\n(2) year term, two (2) police officers of the consolidated police forces with a\nminimum of five (5) or more years' service who shall serve as members of the board\nfor the purpose of deciding discipline cases only, and who may vote in these cases.\nIn case of a vacancy in a position held by a police officer, a new election shall be\nheld within sixty (60) days of the date the vacancy occurs and  the person elected\nshall fill the remainder of the original unexpired term.","path":["KRS Chapter 67C"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24028","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:29Z","sha256":"67b2b339c0b41ea0bcd0714ae04e68d67573d076eefbb29f9bd12da940e35e39","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67c.303","next":"us-ky/krs-67c.307"},"notice":"GroundRules: Original legal text.
