{"data":{"id":"us-ky/krs-67c.321","jurisdiction":"us-ky","citation":"KRS 67C.321","heading":"Actions taken by chief against officers -- Written statement -- Pre-","body":"disciplinary hearing -- Citizen charges of misconduct.\n(1) Subject to the provisions of this chapter, any officer may be removed, suspended\nfor a period not to exceed thirty (30) days, laid-off, or reduced in grade by the chief.\nBefore the discipline may be issued, the chief shall:\n(a) Furnish the officer with a written statement describing the charges being made\nagainst the officer, the evidence upon which the charges a re based, and the\ndiscipline the chief intends to issue; and\n(b) Provide the officer the opportunity for a pre -disciplinary hearing, presided\nover by the chief or the chief's designee, in which the officer may present\nevidence and call and cross-examine witnesses in the officer's defense.\n(2) After any pre-disciplinary hearing conducted under subsection (1)(b) of this section,\nthe chief or the chief's designee shall issue a written opinion setting forth the final\ndiscipline issued against the officer. The o fficer may appeal the discipline issued\nunder this section to the board within ten (10) days of the issuance of the written\nopinion.\n(3) If the officer elects not to proceed with a pre -disciplinary hearing under subsection\n(1)(b) of this section, the disci pline stated in the written statement required by\nsubsection (1)(a) of this section shall become final ten (10) days after that statement\nis furnished to the officer.\n(4) After any citizen makes a written, sworn complaint of misconduct concerning the\nactions of any police officer, if the chief of police determines not to file charges\nagainst the officer based on that complaint, the citizen may appeal the\ndetermination of the chief of police to the board.","path":["KRS Chapter 67C"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55791","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:29Z","sha256":"69ee2b68bdb1629c614b74239434da712334488baa4a76b1b83767b7357766d8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-67c.319","next":"us-ky/krs-67c.323"},"notice":"GroundRules: Original legal text.
