{"data":{"id":"us-ky/krs-68.530","jurisdiction":"us-ky","citation":"KRS 68.530","heading":"Fiscal court resolution and order designating submission of proposals to","body":"voters -- Election -- Framing of questions.\n(1) In the event the fiscal court of any county determines that the public interest\nrequires the establishment of one or more public se rvice programs and that existing\ncounty revenues are inadequate to reasonably provide for such programs, the fiscal\ncourt may by resolution and order determine that one or more questions for the\nestablishment of any such public service program shall be sub mitted to the\nelectorate of such county. Such resolution and order shall designate with specificity\neach public service program to be submitted, together with the proposed source of\nfunding therefor, which shall be either an ad valorem tax levy of a certain maximum\nnumber of cents per each one hundred dollars ($100) of assessed valuation subject\nto constitutional limits, or an occupational license tax subject to the limitations of\nKRS 68.520 to 68.550.\n(2) The fiscal court shall, following adoption of the r esolution and order identified in\nsubsection (1) of this section, cause to be prepared a question for submission to the\nvoters of the county at an election held pursuant to notice as prescribed in KRS\n424.130. Said election shall be held in conjunction wit h a regularly scheduled\nNovember election, as provided by law. The question as it will appear on the ballot\nshall be filed with the county clerk not later than the second Tuesday in August\npreceding the regular election.
