{"data":{"id":"us-ky/krs-7.117","jurisdiction":"us-ky","citation":"KRS 7.117","heading":"Legislative drafting communications not subject to disclosure -- Application.","body":"(1) A member of the General Assembly is immune from disclosing in a civil or\ncriminal court proceeding, or in an administrative or legislative proceeding, any\ncommunication:\n(a) Made by the member of the General Assembly to a member of the staff of the\nLegislative Research Commission, or to a member of the staff of the General\nAssembly, with regard to a request for legislative drafting of bills or\nresolutions or amendments thereto or to any information surrounding such a\nrequest; or\n(b) Received from a member of the staff of the Legislative Research Commission,\nor from a member of the staff of the General Assembly, with regard to a\nrequest for legislative drafting of bills or resolutions or amendments thereto or\nto any information surrounding such a request.\n(2) A member of the staff of the Legislative Research Commission or a member of the\nstaff of the General Assembly is immune from disclosing in a civil or criminal court\nproceeding, or in an administrative or legislative proceeding, any communications:\n(a) Made to him or her by a member of the General Assembly with regard to a\nrequest for legislative drafting of bills or resolutions or amendments thereto or\nto any information surrounding such a request; or\n(b) Made to a member of the General Assembly with regard to a request for\nlegislative drafting of bills or resolutions or amendments thereto or to any\ninformation surrounding such a request.\n(3) This section shall not apply to a criminal court proceeding in which a member of the\nGeneral Assembly, a member  of the staff of the Legislative Research Commission,\nor a member of the staff of the General Assembly is the subject of the proceeding,\nand a subpoena has been issued for the communication or related information.\n(4) The communications referenced in this section or documents related thereto are not\nsubject to subpoena, deposition, writ of mandamus, interrogatory, or other\ndisclosure.\n(5) Any order or subpoena purporting to compel testimony or the production of\nevidence which is prohibited under this section shall be unenforceable.\n(6) This section applies to a former legislator or former member of the staff of the\nLegislative Research Commission or General Assembly only with regard to\ncommunications made or received while a member of the General Assembly or\nmember of the staff of the Legislative Research Commission or General Assembly.\nFor purposes of this section, legislative interns, paid or unpaid, are considered to be\nmembers of the staff of the Legislative Research Commission or General Assembly,\nas applicable.","path":["KRS Chapter 7"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=464","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:26Z","sha256":"a763e4a45378642ac7bc914031188120f6f521a13afee227ce783d2f524c3cae","source_id":"us-ky","stale":false,"prev":"us-ky/krs-7.115","next":"us-ky/krs-7.119"},"notice":"GroundRules: Original legal text.
