{"data":{"id":"us-ky/krs-70.045","jurisdiction":"us-ky","citation":"KRS 70.045","heading":"Special deputies.","body":"(1) (a) The sheriff of a county with a population of ten thousand (10,000) or more\nmay appoint and have sworn in and entered on the county clerk order book\neither:\n1. One (1) special deputy for each two thousand five hundred (2,500)\nresidents or part thereof in his county; or\n2. Up to a maximum of ten (10) special deputies, regardless of the\npopulation of the county;\nto assist him with general law enforcement and maintenance of public order.\n(b) The sheriff of a county with a population of less than ten thousand (10,000)\nmay appoint and have sworn in and entered on the county clerk order book\none (1) special deputy for each one thousand (1,000) residents or part thereof\nin his county, to assist him with general law enforcement and maintenance of\npublic order.\nThe population of the county shall be determined by the most recent count or\nestimate by the Federal Bureau of Census.\n(2) The sheriff in each county may appoint and have sworn in, and entered on the\ncounty clerk order book, as many special deputies as neede d to assist him in the\nexecution of his duties and office in preparation for or during an emergency\nsituation, such as fire, flood, tornado, storm, or other such emergency situations. For\npurposes of this section only, an emergency situation is a condition  which, in the\njudgment of the sheriff, requires a response immediately necessary for the\npreservation of public peace, health or safety, utilizing special deputies previously\nappointed in preparation for the contingency.\n(3) The special deputy shall:\n(a) Be appointed and dismissed on the authority of the sheriff;\n(b) Not receive any monetary compensation for his time or services;\n(c) Serve at the request of the sheriff, unless personal conditions rule otherwise;\n(d) Be answerable to and under the supervision of the sheriff, who shall be\nresponsible for the actions of the special deputy; and\n(e) Be appointed regardless of race, color, creed, or position.\n(4) The position of special deputy as created and defined in subsections (1), (2), and (3)\nis subject to the provisions of this section only.","path":["KRS Chapter 70"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47723","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:31Z","sha256":"ebd518109bdee0f16a67ef2f943b5776d48025489142780260a2dc3e90d1d9aa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-70.040","next":"us-ky/krs-70.050"},"notice":"GroundRules: Original legal text.
