{"data":{"id":"us-ky/krs-70.265","jurisdiction":"us-ky","citation":"KRS 70.265","heading":"Deputy sheriff merit boards to employ chief examiner -- Duties.","body":"(1) Deputy sheriff merit boards shall employ a chief examiner who shall operate under\nthe board's sole supervision.\n(2) The board shall only employ a person for this position who is qualified and\nexperienced in the field of testing.\n(3) The examiner shall desi gn, administer, and evaluate all written tests the board\nrequires applicants for promotion to take for consideration for promotion. Each\napplicant for promotion shall be given an oral and written examination to determine\nthe applicant's qualification for promotion.\n(4) The examiner shall select a panel of three (3) persons to conduct the oral portion of\nthe exam battery. The panel shall be selected from an agency other than the local\nsheriff's office, and the panel members shall be of at least the same rank  to which\nthe applicant aspires and of the same field.\n(5) Unless the sheriff certifies that the applicant is not physically fit for promotion,\nphysical fitness shall be presumed.\n(6) (a) The composite score of the examination battery shall be calculated as follows:\n1. Sixty-five percent (65%) for the written examination; and\n2. Thirty-five percent (35%) for the oral examination.\n(b) An applicant shall receive one (1) seniority point to be added to the composite\nscore for each full year over three (3) full years of service. No applicant shall\nreceive more than ten (10) seniority points. No applicant shall receive a\nseniority point for serving less than a full year.\n(7) Testing and scoring methods shall not depart from, or be inconsistent with, those set\nout in this section.\n(8) The chief examiner shall deliver the final scores of the applicants for promotion, in\na manner that will ensure complete privacy and confidentiality of the applicants and\ntheir scores, directly to the chair of the board. The chief exam iner shall not release\nthis information to anyone but the chair of the board.\n(9) Notice of the date, time, and place of examinations shall be given no later than\nninety (90) days before the examination date.\n(10) Promotions shall be filled by the sheriff from a list of no more than three (3) of the\ncandidates who obtained the highest combined scores on the written and oral\nexamination, including any seniority points, and are physically fit to serve in the\nnew capacity.","path":["KRS Chapter 70"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24220","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:32Z","sha256":"6a514ccb2ed2e5734c4d209423eeab477ca708f3c5f44f337b51ff0de903fb9f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-70.263","next":"us-ky/krs-70.267"},"notice":"GroundRules: Original legal text.
