{"data":{"id":"us-ky/krs-70.290","jurisdiction":"us-ky","citation":"KRS 70.290","heading":"Employment contract for deputy sheriff or peace officer -- Reimbursement","body":"of law enforcement agency when deputy or peace officer accepts employment\nwith another agency.\n(1) (a) City and county law enforcement agencies, including sheriff's offic es, may, as\na condition of employment, require a newly appointed deputy sheriff or peace\nofficer who will participate in the Kentucky Law Enforcement Foundation\nFund Program, authorized by KRS 15.410 to 15.510, to enter into an\nemployment contract for a pe riod of no longer than five (5) years from the\ndate of graduation from the Department of Criminal Justice Training, or other\ntraining approved by the Kentucky Law Enforcement Council.\n(b) If a deputy sheriff or peace officer who has entered into a contract  authorized\nunder this subsection accepts employment as a peace officer with another law\nenforcement agency, including a local school board that has established a\npolice department under KRS 158.471, that law enforcement agency shall\nreimburse the law enforcement agency that initially hired the deputy sheriff or\npeace officer for the actual costs incurred and expended by the law\nenforcement agency that initially hired the deputy sheriff or peace officer\nwhich are associated with the initial hiring of that o fficer, including but not\nlimited to the application process, training costs, equipment costs, salary and\nfringe benefits. The law enforcement agency that initially hired the deputy\nsheriff or peace officer shall be reimbursed for the costs from the time o f the\ndeputy sheriff or peace officer's initial application until graduation from the\nDepartment of Criminal Justice Training.\n(c) 1. For contracts entered into before June 29, 2017, the amount of\nreimbursement authorized by this subsection shall be prorat ed based\nupon the percentage of time that the deputy sheriff or peace officer\ncompleted of his or her employment contract. The amount of\nreimbursement authorized by this subsection after the pro rata amount is\ncalculated shall be reduced by the cost of the  training provided by the\nDepartment of Criminal Justice Training for the subject officer.\n2. For contracts entered into on or after June 29, 2017, the amount of\nreimbursement authorized by this subsection shall not be prorated, and\nshall be for the full a mount as calculated in paragraph (b) of this\nsubsection.\n(2) If a peace officer, including a university police officer, who has been employed by a\nstate law enforcement agency for five (5) years or less accepts employment as a\npeace officer with a city or local law enforcement agency, including a local school\nboard that has established a police department under KRS 158.471, that city or local\nlaw enforcement agency shall reimburse the state law enforcement agency that\ninitially hired the peace officer for t he costs expended with the initial hiring of that\nofficer, including but not limited to the application process, training costs,\nequipment costs, salary and fringe benefits. The state law enforcement agency that\ninitially hired the peace officer shall be r eimbursed for the costs incurred and\nexpended from the time of the peace officer's initial application until graduation\nfrom a Kentucky Law Enforcement Council-approved training academy.","path":["KRS Chapter 70"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53795","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:32Z","sha256":"3da92c4c76ae95f3e44833931aaa9fcf67902b3924e1137e67b5c5c2f3dbd879","source_id":"us-ky","stale":false,"prev":"us-ky/krs-70.284","next":"us-ky/krs-70.291"},"notice":"GroundRules: Original legal text.
