{"data":{"id":"us-ky/krs-70.990","jurisdiction":"us-ky","citation":"KRS 70.990","heading":"Penalties.","body":"(1) If the sheriff fails to renew the bond required of him by KRS 70.020 when ordered\nto do so by the county judge/executive, the county judge/executive shall suspend\nhim from acting until he conforms with the order, or may vacate his office.\n(2) If the sherif f violates any of the provisions of KRS 70.140, he shall be guilty of a\nviolation.\n(3) Any sheriff who knowingly makes a false or illegal return on any process or fee-bill,\nby color of his office, shall be guilty of a Class A misdemeanor and liable to the\nperson injured for treble the damage caused thereby.\n(4) If the constable fails to give additional security or to renew his bond when ordered\nto do so by the county judge/executive, the county judge/executive shall enter an\norder declaring his office vacant.\n(5) Any constable who executes any process, other than a fee -bill for his own service,\nin which he is personally interested shall be guilty of a violation.\n(6) Any constable who violates any of the provisions of KRS 70.390 shall be guilty of a\nviolation. If he violates subsections (1) or (2) of KRS 70.390, he shall be liable for\nthe amount of the claim.\n(7) Any constable or deputy constable in any county containing a population of over\n250,000 who violates any of the provisions of KRS 70.440 shall be guilty of a Class\nD felony.\n(8) If the constable fails to return any process, placed in his hands, by the return day,\nthe plaintiff may recover five dollars ($5) from him upon motion before the court\nfrom which the process issued.\n(9) If a constable fails wit hout reasonable excuse to return process placed in his hands\nfor collection within twenty (20) days after the return day, he shall be liable for the\namount of the process plus ten percent (10%).","path":["KRS Chapter 70"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24263","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:32Z","sha256":"4e6106633f8dbdae44b52328d63dae3f3c091f5f1c70b0ef86a6ccd3aced944d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-70.610","next":"us-ky/krs-71.010"},"notice":"GroundRules: Original legal text.
