{"data":{"id":"us-ky/krs-74.025","jurisdiction":"us-ky","citation":"KRS 74.025","heading":"Removal of district water commissioner -- Causes.","body":"(1) From and after the creation and establishment of a water district and the\nappointment of water commissioners to manage the affairs of the district, and\nfollowing the acquisition or construction by any duly created and established water\ndistrict of a public  water system, and the consequent establishment of regulatory\njurisdiction over such water district by the Public Service Commission of Kentucky,\nthe Public Service Commission may remove any water commissioner from his\noffice for good cause, including, int er alia, incompetency, neglect of duty, gross\nimmorality, or nonfeasance, misfeasance, or malfeasance in office, including\nwithout limiting the generality of the foregoing, failure to comply with rules,\nregulations, and orders issued by the Public Service Commission.\n(2) No such order of removal with respect to any water commissioner shall be entered\nby the Public Service Commission until a public hearing on the merits with\nreference to such matter has been held by the commission, at which hearing the\nwater commissioner proposed to be removed from office shall be afforded the\nopportunity to appear, either pro se, or by counsel and file briefs, memoranda and\nmotions, cross -examine witnesses, examine exhibits, and present evidence, both\norally and in writing. All such orders of removal entered by the Public Service\nCommission shall be final and shall not be subject to appeal. Any water\ncommissioner may waive such public hearing, in which case an order on removal\nmay be forthwith entered by the commission.\n(3) Using procedures of this section the Public Service Commission may also request\nthe removal of directors, trustees or other governing persons of water associations in\nlike manner.","path":["KRS Chapter 74"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42917","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:34Z","sha256":"d559ff38fe99f790ede19b9ffa5a785fa8037ec356d45af222612541848cca70","source_id":"us-ky","stale":false,"prev":"us-ky/krs-74.020","next":"us-ky/krs-74.030"},"notice":"GroundRules: Original legal text.
