{"data":{"id":"us-ky/krs-74.130","jurisdiction":"us-ky","citation":"KRS 74.130","heading":"Classification of lands for assessments -- Report.","body":"(1) The commission shall examine the real estate in the district that may be affected by\nthe proposed water system, and classify it into five (5) classes according to the\nbenefit it will receive from the construction and operation of the water system. The\nreal estate receiving the most benefit shall be marked \"class A,\" and the other\nclasses shall be marked \"class B,\" \"class C,\" \"class D\" and \"class E,\" respectively,\nthe real estate receiving the smallest benefit being marked \"class E.\" All real estate\nactually receiving water shall be placed in the highest classification. The amount of\nreal estate owned by any person in each class, and the extent benefited shall be\ndetermined. The scale of assessment to be made by the commission upon the\nseveral classes shall b e in the ratio of five (5), four (4), three (3), two (2) and one\n(1). The classification shall form the basis of the assessment of benefits to the real\nestate for all purposes.\n(2) If the commission believes that substantial injustice will be done any land owner by\nstrict conformity to the five (5) class rule above, the classification may be changed\nby diminishing or increasing the number of classes so as to conform to existing\nconditions.\n(3) The commission shall make a report containing a statement of the estimated cost of\nthe work and improvement to be made in the district, a description of all real estate\nin the district, showing the amount of real estate in each class, in tabulated form,\nand the names of the owners, and a statement of the estimated benef its that will\naccrue to each class of real estate by reason of the construction of the proposed\nimprovements.","path":["KRS Chapter 74"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24377","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:34Z","sha256":"2442a109360810671e22cfc681ae45be40a96188ccc123ff6a72b24baacf4e77","source_id":"us-ky","stale":false,"prev":"us-ky/krs-74.120","next":"us-ky/krs-74.140"},"notice":"GroundRules: Original legal text.
