{"data":{"id":"us-ky/krs-74.160","jurisdiction":"us-ky","citation":"KRS 74.160","heading":"Striking assessments from roll -- Procedure.","body":"After the assessment roll has been confirmed or modified by the county judge/executive,\nif the commission is unable to furnish water to the owner of any land in the district, or if\nthe land in any part of the district is so sparsely populated that in the o pinion of the\ncommission water could not be furnished to the owners thereof without incurring an\nunreasonable burden of additional assessment against the lands or an unreasonable burden\nof indebtedness against the water district without receiving any corre sponding return in\nthe profits realized from the sale of water in the territory, the commission may strike the\nassessments on land not receiving water from the assessment roll, or may reduce the\nassessments to conform with the benefits received, and refund  to the respective owners\nany assessments collected that have been stricken off or reduced. After striking or\nreducing such assessments, the commission shall file a petition with the county\njudge/executive setting out the reasons why the assessments should  be stricken off or\nreduced, with a certified copy of the assessments so stricken off or reduced. The county\njudge/executive shall then set the proceeding for a hearing, and after giving at least ten\n(10) days' notice of the time of the hearing, the county  judge/executive shall hear all\nobjections to the order of the commission striking or reducing the assessment, and shall\nenter an order confirming the action of the commission or directing them to change the\nassessment roll in accordance with the finding of the county judge/executive. The order of\nthe county judge/executive confirming or modifying the order of the commission striking\noff or reducing the assessment may be appealed from. If a deficit is incurred by striking or\nreducing any assessment so as to  make the assessments insufficient to pay any bonded\nindebtedness of the water district, the deficit shall be paid out of the general fund of the\ndistrict realized from all other revenues collected or to be collected in the district.","path":["KRS Chapter 74"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24380","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:34Z","sha256":"62cbbfaf47704f9687db74f318fdf49eeb7fe74d8c2659c0083ac3b54fb011fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-74.150","next":"us-ky/krs-74.170"},"notice":"GroundRules: Original legal text.
