{"data":{"id":"us-ky/krs-74.363","jurisdiction":"us-ky","citation":"KRS 74.363","heading":"Merger of water districts -- Board of resulting district -- Transfer of","body":"assets -- Payment  of obligations.\n(1) Boards  of commissioners of any two (2) or more  water districts may  by\nconcurrent action and by approval of a majority of the membership of the board\nof each merge their districts into one (1).\n(2) The  members  of the boards of commissioners of the merged water districts\nshall serve as members  of the board of commissioners of the resulting district,\nregardless of their normal term expiration, until one (1) year after approval of\nthe merger by the Public Service Commission. Thereafter, the board shall be\ncomposed  as follows:\n(a) If the boundaries of the resulting district lie wholly within a single county,\nthe board of commissioners shall be composed  of between three (3) and\nseven (7) members  as agreed upon by the merged water districts in their\nmerger documents; and\n(b) If the boundaries of the resulting district lie within two (2) or more\ncounties, the board of commissioners shall be composed  of six (6) or\nmore  members  as agreed upon by the merged water districts in their\nmerger documents.\n(3) Each  appointment to the board of commissioners of the resulting district shall\nbe made  by the appropriate county judge/executive with the approval of the\nfiscal court. Each member  of the board shall be a resident of the county from\nwhich he or she is appointed. The initial terms of the board of commissioners\nafter the merger shall be as follows: approximately one-third (1/3) of the\ncommissioners shall be appointed for a term of two (2) years; approximately\none-third (1/3) of the commissioners shall be appointed for a term of three (3)\nyears; and the remaining commissioners shall be appointed for a term of four\n(4) years. Thereafter, all commissioners shall be appointed for a term of four\n(4) years. KRS  74.020(2) to (11) shall apply to all commissioners and\nvacancies on the board of commissioners.\n(4) The  resulting district shall have all the assets and legal liabilities of the water\ndistricts joining in the merger. The separate existences of the water districts\njoining in the merger, except the resulting district, shall cease, and the title to\nall real estate and other property owned  by the water districts joining in the\nmerger shall be vested in the resulting district without reversion or impairment.\nBonded  obligations of any district secured by the right to levy an assessment\nas provided by KRS  74.130 through 74.230 or secured by the revenue of the\nsystems operated by the district shall continue to be retired or a sinking fund\nfor such purpose created from the tax assessments or revenue from the\nsystem operated by the district from funds collected over the same area by the\nnew  board of commissioners in accordance with the laws under which the\nbonds  were issued until all bonded obligations of the old district have been\nretired.","path":["KRS Chapter 74"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50718","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:34Z","sha256":"445aab2201cf8500cc09f03f51f3e272baa3a32c8a8839267c297a1abe9877e3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-74.361","next":"us-ky/krs-74.367"},"notice":"GroundRules: Original legal text.
