{"data":{"id":"us-ky/krs-74.367","jurisdiction":"us-ky","citation":"KRS 74.367","heading":"Discontinuance of water district -- Procedure.","body":"(1) At any time after the organization of a water district, and after approval by the\nPublic Service Commission in a proceeding similar to that provided by KRS\n74.012, more than fifty percent (50%) of the freeholders within the district may file\na petition wit h the county judge/executive who had jurisdiction over the\norganization of the district requesting discontinuance of the water district. The\npetition shall state the reasons for discontinuance and that all obligations of the\ndistrict have been met and that approval of the Public Service Commission has been\nobtained.\n(2) After giving notice as provided in KRS Chapter 424 the county judge/executive\nmay conduct such hearings on the petition as may be necessary to assist in making a\ndetermination.\n(3) If, after  hearings on the petition for discontinuance of the district the county\njudge/executive determines that a discontinuance is in the best interest of the\nresidents of the district, the water district shall be dissolved by order of the county\njudge/executive and a copy of the order shall be forwarded to the Public Service\nCommission.","path":["KRS Chapter 74"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24405","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:34Z","sha256":"11b7d50631e44f63e016841eed6c7df810141adc8d0c4be49b0fa285e20005b3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-74.363","next":"us-ky/krs-74.370"},"notice":"GroundRules: Original legal text.
