{"data":{"id":"us-ky/krs-74.407","jurisdiction":"us-ky","citation":"KRS 74.407","heading":"Operation of sewage disposal systems -- Water district's powers to enforce","body":"collection of lawful rates and charges -- Agreement to acquire property outside\nboundaries.\n(1) (a) In addition to the other authority which water districts presently h ave under\nthis chapter, water districts are hereby authorized to acquire, develop,\nmaintain, and operate sewage disposal systems within the confines of their\nrespective districts or as authorized in paragraph (b) of this subsection, except\nthat such sewer systems shall not include territory within the boundaries of\nexisting municipal corporations having the authority to provide such sewer\nservices without the consent of such municipal corporations.\n(b) Water districts may enter into agreements with another entity or entities to\nacquire by purchase or lease, any real or personal property, or any interest,\nright, easement, or privilege therein, outside of the district's jurisdictional\nboundaries, in connection with the acquisition, construction, operation, rep air,\nor maintenance of any sewage, wastewater, or storm water facilities,\nnotwithstanding any other provision of the Kentucky Revised Statutes\nrestricting, qualifying, or limiting their authority to do so, except as set forth\nin KRS Chapter 278.\n(2) In the event of annexation of territory within a water district by another municipal\ncorporation authorized to provide sewer systems and services, the water district may\ncontinue to provide and charge for sewer services within such newly annexed areas\nuntil such annexing municipal corporation makes adequate payment, by negotiation\nor condemnation, for such sewage disposal facilities owned and operated by the\nwater district. The water district commissioners shall have all of the powers and\nauthority, as regards sewer systems, that are conferred upon them for the purpose of\nfurnishing a water supply under KRS 74.010 to 74.415.\n(3) If a water district that provides sewer services is also the water supplier, the water\ndistrict may provide that rates for water service and sewer service be billed\nsimultaneously and may enforce collection of lawful rates and charges for sewer\nservices by discontinuing water service until payment of the delinquent charges,\nincluding penalties, interest, and reasonable fees for disconnectio n and\nreconnection, is made or some payment arrangement satisfactory to the water\ndistrict is reached.\n(4) If a water district that provides sewer services is not the water supplier, the water\ndistrict may enforce collection of delinquent sewer service cha rges in the manner\nprovided in KRS 96.930 to 96.943.","path":["KRS Chapter 74"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48312","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:34Z","sha256":"046fd542c9770aadd17d8be12e2ada23f2d1e4c767139bdbfd8475281c20c32a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-74.405","next":"us-ky/krs-74.408"},"notice":"GroundRules: Original legal text.
