{"data":{"id":"us-ky/krs-74.500","jurisdiction":"us-ky","citation":"KRS 74.500","heading":"Procedure for participation by other city or water districts.","body":"After the creation of a water commission provided for by KRS 74.420 to 74.520, a city or\nwater district which did not participate in the creation of said commission may participate\nin its operation and appoint a commissioner to serve on said commission in the following\nmanner:\n(1) The governing body of such city or water district shall adopt and file with the\ncounty judge/executive who entered the order creating said commission an\nordinance or resolution electing and requesting that it be permitted to be in cluded in\nand represented by said commission in the same manner and to the same extent as if\nsaid city or water district had originally participated in the creation of said\ncommission.\n(2) Upon such filing the county judge/executive shall by appropriate order set a date for\na public hearing on the inclusion of such a city or water district in said commission,\nand shall give notice of such public hearing in the manner as provided by KRS\n74.440. Any resident of the city or water district at the time represent ed by said\ncommission, and any resident of the city or water district requesting to be included\nin and represented by said commission and to participate in its operation, may file\nobjections, and at the public hearing if the county judge/executive finds th at the\ninclusion of such city or water district in said commission is reasonably necessary\nor advantageous for the public health, convenience and comfort of the residents of\nall cities and water districts represented by said commission, including the city or\nwater district requesting to be included in said commission, and provided further\nthat there shall be on file with the county judge/executive a resolution adopted by\nsaid commission evidencing its willingness to have such city or water district\nincluded in and represented by said commission the county judge/executive shall\nmake an order authorizing the inclusion of such city or water district in the\ncommission. If the county judge/executive does not find that the inclusion of such\ncity or water district is reasonably necessary or advantageous he shall make an\nappropriate order in this regard. Any party in interest may thereupon appeal to the\nCircuit Court.\n(3) Upon the entering of the order by the county judge/executive authorizing the\ninclusion of such c ity or water district in said commission the number of\ncommissioners, if any, to be appointed to said commission by the county\njudge/executive shall be reduced by one (1) and the presiding officer, with the\napproval of the governing body of the city or wat er district which shall by virtue of\nsaid proceedings be included in and represented by said commission, shall appoint a\ncommissioner whose term shall begin at the expiration of the term of the\ncommissioner appointed by the county judge/executive whose ter m shall first\nexpire. In the event there is no commissioner on said commission appointed by the\ncounty judge/executive the term of the commissioner appointed by the presiding\nofficer of such city or water district shall be fixed so that the terms of approximately\none-third (1/3) of the commissioners will expire in each year.","path":["KRS Chapter 74"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24429","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:34Z","sha256":"8ec1384baf6c305d4b5c38ff3688536910a5aba913eb39bb90670c64af782eca","source_id":"us-ky","stale":false,"prev":"us-ky/krs-74.490","next":"us-ky/krs-74.510"},"notice":"GroundRules: Original legal text.
