{"data":{"id":"us-ky/krs-75.460","jurisdiction":"us-ky","citation":"KRS 75.460","heading":"Payment by insurance company of property owner's bill from fire","body":"department -- Property owner's responsibility.\n(1) If a property owner who is not a member or subscriber of the fire department which\ncharges membership or subscriber fees experiences a fi re, incident, or emergency\nthat the department responds to, he may provide his insurance company with the\nbilling statement from the fire department.\n(2) All insurance companies paying a claim pursuant to subsection one (1) of this\nsection shall make payment of the stated charge for service in the following manner:\n(a) The insurance company may make the check or draft payable to both the\naffected property owner and the affected fire department; or\n(b) The insurance company may make the check or draft payabl e solely to the\naffected fire department.\n(3) If an insurance company makes a claim check or draft payable both to the property\nowner and the fire department, the property owner shall make payment to the fire\ndepartment within thirty (30) days of receipt of the check or draft. If the claim check\nor draft is not sufficient to cover the charge levied by the fire department, the\nproperty owner shall be responsible for payment of the balance to the fire\ndepartment.\n(4) A property owner who is not a member or su bscriber of the fire department who\ndoes not have fire insurance coverage shall be fully responsible for payment of all\ncharges levied by a fire department for services rendered in response to a fire,\nincident, or emergency within thirty (30) days of the d ate of the response by the\ndepartment, or within thirty (30) days of the date of an arbitration award rendered\npursuant to KRS 75.450(2)(c). Payment to the fire department shall be in full,\nunless a written agreement has been reached between the fire depar tment and the\nproperty owner to establish a payment schedule to satisfy all charges to the property\nowner.\n(5) If payment for services rendered has not been received within sixty (60) days from\nthe date of response, or within thirty (30) days of the date o f an arbitration award\nrendered pursuant to KRS 75.450(2)(c), and if a payment schedule has not been\nestablished, a fire department may proceed in small claims court or in other\nappropriate court action to recover from the property owner all fees associate d with\nthe response, including attorney fees and court costs.","path":["KRS Chapter 75"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24470","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:35Z","sha256":"7489defc6006d35fbfb17d5d8db7b2e57c6dab5cf4dc83da095d24a632bd344b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-75.450","next":"us-ky/krs-75.470"},"notice":"GroundRules: Original legal text.
