{"data":{"id":"us-ky/krs-75a.020","jurisdiction":"us-ky","citation":"KRS 75A.020","heading":"Choice of processes by which new consolidated emergency services district","body":"may be formed.\n(1) A new consolidated emergency services district may be formed by one (1) of the\nfollowing processes:\n(a) The board of:\n1. Any two (2) or more fire pro tection districts established under KRS\nChapter 75 or 273, any special district whose services are subject to the\nlicensure provisions of KRS Chapter 311A, or any rescue squads\nestablished under KRS Chapter 39F; or\n2. Any fire protection districts establis hed under KRS Chapter 75 or 273,\nany special district whose services are subject to the licensure provisions\nof KRS Chapter 311A, or any rescue squads established under KRS\nChapter 39F that have merged within the five (5) years prior to the\nadoption of thi s section that would have been eligible to consolidate\nunder the provisions of this section;\n3. May adopt resolutions agreeing to the formation of a consolidated\nemergency services district and requesting the creation of a consolidated\nemergency services d istrict. The governing bodies shall notify the\ncounty fiscal court, consolidated local government, charter county\ngovernment, or unified local government with jurisdiction over the\nproposed district and request the formation of a consolidated emergency\nservices district; or\n(b) The board of any two (2) or more consolidated emergency service districts\nestablished under this chapter may adopt resolutions agreeing to the merger of\nconsolidated emergency services districts and requesting the creation of a new\nconsolidated emergency services district. The governing bodies shall notify\nthe county fiscal court, consolidated local government, charter county\ngovernment, or unified local government with jurisdiction over the proposed\ndistrict and request the formation  of a new consolidated emergency services\ndistrict.\n(2) (a) Any county fiscal court, consolidated local government, charter county\ngovernment, or unified local government, upon receipt of a request from two\n(2) or more fire protection districts, special districts whose services are subject\nto the licensure provisions of KRS Chapter 311A, or rescue squads\nestablished under KRS Chapter 39F, may create a consolidated emergency\nservices district in their jurisdiction by adoption of an ordinance approving the\nestablishment of a consolidated emergency services district and authorizing\nany relevant fire protection district to join if its governing authority has\napproved it to join the consolidated district.\n(b) The ordinance shall describe the boundaries by metes a nd bounds and name\nfor the consolidated district. No consolidated emergency services district shall\ntake effect less than sixty (60) days from completing the required elements\noutlined in this section.\n(c) The county fiscal court, consolidated local govern ment, charter county\ngovernment, or unified local government clerk shall notify all planning\ncommissions, cities, and area development districts within whose jurisdiction\nthe approved service area is located and any state agencies required by law to\nbe notified of the proposal for the creation of the taxing district within thirty\n(30) days from adoption of the ordinance authorizing creation of the district.\n(d) The creation of a consolidated emergency services taxing district shall be of\nlegal effect only after adoption of an ordinance creating the taxing district and\nafter a certified copy of the ordinance creating the taxing district is filed with\nthe county clerk.\n(e) Any aggrieved person may bring an action in the Circuit Court having\njurisdiction of that county to contest the decision of the county fiscal court or\nlegislative body of the county to establish a consolidated emergency services\ndistrict or to protest the inclusion of any county, consolidated local\ngovernment, charter county government, unifi ed local government, fire\nprotection district or volunteer fire department district established pursuant to\nKRS Chapter 75 or 273, any special district whose services are subject to the\nlicensure provisions of KRS Chapter 311A, or any rescue squad establis hed\npursuant to KRS Chapter 39F within a consolidated emergency services\ndistrict.\n(3) (a) If the governing body of any fire protection district establish ed under KRS\nChapter 75 or 273, any special district whose services are subject to the\nlicensure provisions of KRS Chapter 311A, or any rescue squad established\nunder KRS Chapter 39F desires to have its district become part of an\nestablished consolidated e mergency services district after the creation of the\ndistrict, it shall by motion so record its desire in the minutes of the board, in\nthe case of any fire protection district, any emergency medical services special\ndistrict, or any rescue squad. The board  shall convey this request to the\nconsolidated emergency service district's board. Within sixty (60) days of\nreceiving the request the consolidated emergency service district's board shall\nvote upon this request. The approval shall be certified to the cler k of the\ncounty, consolidated local government, charter county government, or unified\nlocal government in the jurisdiction in which the consolidated district is\nlocated.\n(b) The approval of the addition of a district to the consolidated emergency\nservices district shall become effective upon the adoption of an ordinance\namending the ordinance creating the consolidated emergency services district\nby the county fiscal court, consolidated local government, charter county\ngovernment, or unified local government  and authorizing the inclusion of the\npetitioning fire protection district.
