{"data":{"id":"us-ky/krs-75a.090","jurisdiction":"us-ky","citation":"KRS 75A.090","heading":"Contracts between district and fire units or districts, municipal","body":"corporations, rescue squads, and others, for fire protection -- Deemed\ngovernmental functions.\n(1) The district may, through the board, make and enter into contracts with any o ther\nfire protection district, fire prevention district, municipal corporation, volunteer fire\ndepartment, volunteer fire prevention unit, volunteer fire protection unit, any special\ndistrict whose services are subject to the licensure provisions of KRS Ch apter\n311A, or any rescue squads established under KRS Chapter 39F, either within the\nsame county or within an adjoining county in an area adjacent to the boundary line\nbetween the counties, for the furnishing or receiving of emergency services for all\nproperty within the confines of the area included in and covered by the contract or\ncontracts, where these emergency services are not otherwise provided by some\ndivision of government or governmental agency.\n(2) The personnel acting in their official capaciti es and equipment of a contracting\nparty, in going to and returning from an emergency, or in answering and responding\nto a false alarm or call, and while endeavoring to provide emergency services within\nthe area covered by the contract, shall be deemed and is declared to be engaged in\nthe exercise of a governmental function.","path":["KRS Chapter 75A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51258","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:35Z","sha256":"211e4d8ef5133bcfc6c4d365b386c8c6f3053bffd81986f869cf53b3d9f75ced","source_id":"us-ky","stale":false,"prev":"us-ky/krs-75a.080","next":"us-ky/krs-75a.100"},"notice":"GroundRules: Original legal text.
