{"data":{"id":"us-ky/krs-75a.140","jurisdiction":"us-ky","citation":"KRS 75A.140","heading":"Consolidated emergency service district's participation in County","body":"Employees Retirement System -- Status of employees who previously\nparticipated in CERS.\n(1) If a majority of the entities that entered into a consolidated emergency service\ndistrict were participating employers in the County Employees Retirement System,\nthen the district shall apply to become a participating member in the County\nEmployees Retirement System in accordance with KRS 78.530.\n(2) If the district is not required to app ly to participate in the County Employees\nRetirement System as provided for by subsection (1) of this section or does not\nvoluntarily apply to participate in the County Employees Retirement System as\nprovided by KRS 78.530, the following shall apply:\n(a) Any employee who was participating in the County Employees Retirement\nSystem through an entity that is entering into or petitioning to join in a\nconsolidated emergency services district, shall, provided the employee\nparticipating in the system through the e ntity immediately prior to the entity\njoining the district, remain a participating employee in the County Employees\nRetirement System in the existing classification of retirement tier and\nhazardous duty classification for the remainder of his or her employ ment with\nthe district as provided by KRS 78.510 to 78.852; and\n(b) For the purposes of this subsection, the district shall be considered a\nparticipating employer of the County Employees Retirement System, but only\nfor those employees described by paragraph (a) of this subsection.","path":["KRS Chapter 75A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51263","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:35Z","sha256":"a290e1864c50e2c447dbdd58cf7972baced7ebae015768312f12c7ba0248b534","source_id":"us-ky","stale":false,"prev":"us-ky/krs-75a.130","next":"us-ky/krs-76.005"},"notice":"GroundRules: Original legal text.
