{"data":{"id":"us-ky/krs-76.005","jurisdiction":"us-ky","citation":"KRS 76.005","heading":"Definitions.","body":"As used in KRS 76.010 to 76.295 unless the context otherwise requires:\n(1) \"District\" means a metropolitan sewer district authorized by KRS 76.010 to 76.210.\n(2) \"Board\" means the board described in KRS 76.030.\n(3) \"District area,\" \"within the district,\" \"corporate limits of the district\" and similar\nterms mean that area of a county containing a city of the first class which area was\non April 1, 1964, either inside the city of the first class or served by sanitary or\ncombined sanitary and storm water sewers which were under the immediate control\nand custody of the district, that area of such a county which is added to the district\npursuant to KRS 76.170, and that area of such a county which may be annexed to\nthe city of the first class except that no constr uction subdistrict shall be construed to\nbe within the district area.\n(4) \"Construction subdistrict bonds and obligations\" and like phrases mean any\nobligation whatsoever that has been incurred by the district because of some\nfunction or activity of a cons truction subdistrict. Such debts are not obligations of\nthe district, and such debts may be paid only from moneys received by the district\non account of the construction subdistrict, or from the funds, if any, in the\nconstruction subdistrict reserve fund.\n(5) \"Construction subdistrict facilities\" are all sewerage facilities within a construction\nsubdistrict, and all sewerage facilities in a county containing a district outside the\ndistrict area which:\n(a) Are not a part of a sewer construction district orga nized pursuant to KRS\n76.300 to 76.420 or a sanitation district organized pursuant to KRS 220.010 to\n220.540 or a sewer system of a municipal corporation or a sewer system of a\nwater district organized pursuant to KRS 74.010 to 74.415; and\n(b) Join togethe r two (2) or more construction subdistricts or lead from a\nconstruction subdistrict to the district area or lead from a construction\nsubdistrict to a disposal plant or a treatment plant outside the construction\nsubdistrict and outside the district area.\n(6) \"District facilities\" are all facilities of the district within the district area.","path":["KRS Chapter 76"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24472","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:35Z","sha256":"114ce2bd7075ed13ca62b78104ddc7f5acd42d4c5d26fb658aaa1fc67e925419","source_id":"us-ky","stale":false,"prev":"us-ky/krs-75a.140","next":"us-ky/krs-76.007"},"notice":"GroundRules: Original legal text.
