{"data":{"id":"us-ky/krs-76.120","jurisdiction":"us-ky","citation":"KRS 76.120","heading":"Facilities of public service corporations, expense of reconstructing or","body":"replacing -- Entering upon or damaging public way or place.\nWhere railroad tracks, street railroad tracks, gas or water pipes, telephone wires, telegraph\nwires, electric light or p ower lines, or conduits, for carrying telephone or telegraph or\nelectric wires, or poles, or other structures of any public service corporation, extend in,\nalong or across any part of the work authorized by KRS 76.010 to 76.210, it shall be and\nbecome the duty of the person or corporation owning or using such tracks, pipes, wires,\nconduits, poles, or other structures, to make such changes in the same at the expense of\nthe district as may be required during the construction of any improvement provided for\nin KRS 76.010 to 76.210, and to construct or rebuild at the expense of the district its\ntracks, pipes, wires, conduits, poles, or other structures, over or along the work by KRS\n76.010 to 76.210 authorized and constructed, and at its own expense to maintain the same\nafter such work has been completed; provided, however, such changes of that part of such\ntracks, pipes, wires, conduits, poles or other structures as may be or extend in a public\nway, shall be made at the expense of the public service corporation owning or using the\nsame only if necessary to afford the district reasonable use of such public way.\nReasonable notice in writing of such necessary changes shall be given by the district to\nthe parties concerned. The district may, after obtaining the writt en approval of the agency\nowning the right -of-way thereof, enter upon streets, highways, bridges, or public places,\nfor the purpose of constructing any additions, betterments, or extensions of the facilities\nof the district.
