{"data":{"id":"us-ky/krs-76.232","jurisdiction":"us-ky","citation":"KRS 76.232","heading":"Establishment of joint sewer agency by city with population of less than","body":"20,000 to less than 100,000 with county or sanitation district -- Powers --\nAdministration.\n(1) A city with a population less than twenty thousand (20,000) based upon the  most\nrecent federal decennial census together with the county in which it is located or\ntogether with the sanitation district, or any city with a population equal to or greater\nthan twenty thousand (20,000) but less than one hundred thousand (100,000) bas ed\nupon the most recent federal decennial census together with the county in which it\nis located or together with the sanitation district, as an alternative to establishing a\nmetropolitan sewer district under KRS 76.010, may jointly establish a sewer agency\nfor the purpose of providing sewer and drainage facilities within the city and the\ncounty or within the city and the sanitation district.\n(2) In order to establish a joint sewer agency under this section, the legislative body of\nthe city, the fiscal cour t of the county, or the governing body of the sanitation\ndistrict may vote to merge any existing agency or sanitation district or any portion\nthereof into the jointly established sewer agency or into an existing city or county\nsewer agency. If the legislat ive body of the city, fiscal court of the county, or\ngoverning body of the sanitation district determines to merge an existing agency or\nsanitation district into the joint sewer agency, it shall determine a method to satisfy\nany legal obligations of the ex isting agency or sanitation district which might be\naffected.\n(3) A joint sewer agency shall be established upon the enactment of identical\nagreements establishing and setting out the powers of the sewer agency by all\nparties establishing the joint sewer a gency. Any agreement enacted by a city or\ncounty shall be by ordinance. Any agreement enacted by a sanitation district shall be\ndone in the same manner as any other official actions taken by the sanitation\ndistrict.\n(4) All the powers granted a metropolita n sewer district and cities of the first class by\nKRS 76.010 to 76.279 may be granted by ordinance to the joint sewer agency\nexcept that such powers may be restricted or qualified in order to conform to the\nlocal needs of the county, city, and sanitation district.\n(5) The joint sewer agency shall be administered as a separate legal entity or by a\njointly appointed administrator, joint board, or one of the merging entities, as set out\nin the ordinance creating the joint sewer agency.\n(6) The joint sewer agen cy may be dissolved only by adoption of an ordinance of the\nlegislative body of the city and the fiscal court of the county. The ordinance creating\nthe joint sewer agency shall be amended in the same manner as originally enacted.\n(7) The legislative body o f any city with a population of less than twenty thousand\n(20,000) based upon the most recent federal decennial census may by ordinance\nelect to be within the jurisdiction of a joint sewer agency established pursuant to\nthis section.\n(8) The joint sewer ag ency may enter into agreements with another entity or entities to\nacquire by purchase or lease, any real or personal property, or any interest, right,\neasement, or privilege therein, outside of the agency's jurisdictional boundaries, in\nconnection with the  acquisition, construction, operation, repair, or maintenance of\nany sewage, wastewater, or storm water facilities, notwithstanding any other\nprovision of the Kentucky Revised Statutes restricting, qualifying, or limiting their\nauthority to do so, except as set forth in KRS Chapter 278.","path":["KRS Chapter 76"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48315","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:36Z","sha256":"5b80b5f748ea6542520d494d909b4cdf1a17fe2b602d159e368268575935729f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-76.231","next":"us-ky/krs-76.233"},"notice":"GroundRules: Original legal text.
