{"data":{"id":"us-ky/krs-76.269","jurisdiction":"us-ky","citation":"KRS 76.269","heading":"Other districts to become construction subdistricts when -- Incorporated in","body":"district when.\nA sanitation district organized under KRS 220.010 to 220.540, a sewer construction\ndistrict organized under KRS 76.300 to 76.420, and a sewage system owned by an y\nmunicipality, political subdivision, or any other entity, public or private, may be made a\nconstruction subdistrict or incorporated into the district area by the board under the\nconditions of this section.\n(1) Any such district or system may be made a construction subdistrict only when:\n(a) Express, written consent of all bondholders and secured creditors has been\nobtained;\n(b) The governing body or owner of such district or system has consented in\nwriting; and\n(c) The board has determined that the po licy of KRS 76.010 to 76.295 will best\nbe served by making such district or system a construction subdistrict.\n(2) When such district or system has been made a construction subdistrict under\nsubsection (1), KRS 76.241 to 76.253 and KRS 76.257 to 76.259 sh all not apply to\nit.\n(3) Any such district or system may be incorporated by the board into the district area\nonly when:\n(a) All debts of the district or system have been paid or an amount of either\nmoney or securities lawful as investments under KRS 386. 020 has been laid\naside to pay them by the governing body or owner of such district or system;\n(b) The governing body or owner of such district or system has consented in\nwriting;\n(c) Such district or system is not within a sanitation tax district organiz ed under\nKRS 76.274; and\n(d) The board has determined that the policy of KRS 76.010 to 76.210 will best\nbe served by incorporating such district or system into the district area.","path":["KRS Chapter 76"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24534","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:36Z","sha256":"ac60c8dd3f63add96e5d7bbd3632d9335734f289dd71d4208a229288eb7b5175","source_id":"us-ky","stale":false,"prev":"us-ky/krs-76.268","next":"us-ky/krs-76.270"},"notice":"GroundRules: Original legal text.
