{"data":{"id":"us-ky/krs-76.305","jurisdiction":"us-ky","citation":"KRS 76.305","heading":"Notice and proceedings for establishment of sewer construction district --","body":"Appeal.\n(1) When the petition is filed the county clerk shall give notice of the filing by\npublication pursuant to KRS Chapter 424 and by posting notices in three (3) public\nplaces within the proposed district. Within thirty (30) days after the publication, any\nfreeholder of the proposed district may file objections, and the county\njudge/executive shall set the case for hearing at the first rule day after expiration of\nsaid thirty (30) days. If the county judge/executive finds that the establishment of\nsuch district is reasonably necessary for the public health, convenience and comfort\nof the residents of the district, he shall make an order establishing the district and\ndesignating it by name and number.\n(2) If the county judge/executive finds that the district is not necessary, he may dismiss\nthe petition. If the county judge/executive finds that any part of the territory will not\nbe benefited, he may strike such part.\n(3) Any party may appeal to the Circuit Court from the order establishing a district or\ndismissing the petition or striking or refusing to strike any territory from the district.\nFrom a decision of the Circuit Court any party may appeal to the Court of Appeals.","path":["KRS Chapter 76"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24550","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:36Z","sha256":"ca14e276fcbfae61af6c3e61a543e8a4bce65e996b815a73e1f674db040cdf4e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-76.300","next":"us-ky/krs-76.310"},"notice":"GroundRules: Original legal text.
