{"data":{"id":"us-ky/krs-76.325","jurisdiction":"us-ky","citation":"KRS 76.325","heading":"Powers of commission.","body":"The powers of the commission shall be:\n(1) To construct, operate and maintain a sewerage and/or drainage system and sewers\nand drains within the boundaries of the sewer construction district, or to contract\nwith a metropolitan sewer district for such construction, operation and/or\nmaintenance;\n(2) To provide for disposition of the sewage and/or drainage, and for treatment of\nsewage, either through its own facilities or by contract with the metropolitan sewer\ndistrict;\n(3) To clean out, straighten, alter, deepen, fill up or otherwise improve any st ream,\nwatercourse receiving sewage, liquid wastes or drainage, located in or out of the\ndistrict;\n(4) To construct, operate and maintain trunk sewers, intercepting sewers, laterals,\nsiphons, pumping stations, sewage treatment and disposal works necessary for the\npurposes of the district, through its own facilities or by contract with the\nmetropolitan sewer district;\n(5) To hold, control, acquire by purchase, donation or condemnation any real or\npersonal property necessary for location, construction, opera tion or maintenance of\nits works and improvements and easements for rights of way;\n(6) Upon completion of construction of any integral part of the sewer or drainage\nsystem, to contract for the operation and maintenance of its works and\nimprovements or easements for rights of way;\n(7) Upon completion of construction of any integral part of the sewer or drainage\nsystem, to contract for the operation and maintenance of, and extensions to, such\npart of the system, with the metropolitan sewer district on a ser vice basis for the\nusers, or, with the approval of the court, to have the territory in such part of the\nsewer construction district incorporated into the metropolitan sewer district for\nservice as provided to other property within said metropolitan sewer district; and\n(8) To enter into agreements with another entity or entities to acquire by purchase or\nlease, any real or personal property, or any interest, right, easement, or privilege\ntherein, outside of the district's jurisdictional boundaries, in connec tion with the\nacquisition, construction, operation, repair, or maintenance of any sewage,\nwastewater, or storm water facilities, notwithstanding any other provision of the\nKentucky Revised Statutes restricting, qualifying, or limiting their authority to do\nso, except as set forth in KRS Chapter 278.","path":["KRS Chapter 76"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48316","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:36Z","sha256":"7b1b97effa9a738e35df277c03393548883b3bd902045bd53bff9901a2fd9168","source_id":"us-ky","stale":false,"prev":"us-ky/krs-76.320","next":"us-ky/krs-76.326"},"notice":"GroundRules: Original legal text.
