{"data":{"id":"us-ky/krs-76.640","jurisdiction":"us-ky","citation":"KRS 76.640","heading":"Enforcement powers.","body":"(1) Any metropolitan sewer district which has initiated a wastewater collection project\nunder the provisions of KRS Chapters 76 and 107 may enforce payment of annual\nimprovement benefit assessments levied in respect of such project and may enforce\nrules and re gulations relative to this project by directing the company or\ngovernmental unit providing water services to any benefited property to discontinue\nwater services until:  (a)  the improvement benefits and penalties are duly paid and\n(b) the regulations and rules shall have been duly complied with and any defaults\nhave been cured.  However, a metropolitan sewer district shall indemnify the\ncompany or governmental unit providing water services from any liability for\ndamages for terminating water services upon the direction of a district.\n(2) Water suppliers shall be entitled to collect from owners of benefited properties a\nreasonable fee for termination and reinstatement of water services.\n(3) It shall be lawful for metropolitan sewer districts initiating was tewater collection\nprojects to covenant with holders of bonds that the district shall enforce the\nprovisions of this section.\n(4) Notwithstanding the foregoing provisions of this section, metropolitan sewer\ndistricts initiating projects pursuant to KRS Ch apters 76 and 107 shall have all\npowers and rights granted to cities and sewer bodies by KRS 96.930 through\n96.943.","path":["KRS Chapter 76"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24599","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:37Z","sha256":"a553bbdeefbbbccd896c06e5b9e99ceb949e2c8129ca4edcc7f4765cb2597f62","source_id":"us-ky","stale":false,"prev":"us-ky/krs-76.630","next":"us-ky/krs-77.005"},"notice":"GroundRules: Original legal text.
